My parents,my brother and myself landed in Canada in April 2009, my parents left after staying here for 4 months. I came back in 2011 and my brother stayed back. My brother has applied for Citizenship and I will apply in a year. My parents are planning to comeback in April 2013 (for good ). Their PR cards are valid till May 2014. The question is by May 2014 they will not be able to complete 2 years in Canada. They would be falling short by atleast 7 months i.e around 210 days from the requirement of 730 days. However I have heard that if they stay here till 2015 (ofcourse they can't travel out of Canada, if they do they won't be able to come back) i.e spend 2014-2015 in Canada without renewing the PR card and renew the PR card in 2015 since they would have spent 2 years by then. The question now is will they be allowed entry when they come in April 2013, do the immigration officers try to determine whether one can complete 2 years before expiry or take action. If they take action will my parents be deported/will not be allowed to enter Canada? I also heard they may allow with a 30 day window time to appeal. How does that work? I am planning to book tickets for them soon and I want to be aware of different possible scenarios so that I am prepared.
I do know that they can stop your parents from entering since the minimum period for retaining PR Card is not met.... We hurried to Canada ourselves to avoid this and came here with days to spare in the 2 yr threshold... From what we had gathered at that time, it would depend on the immigration officer you get..... Try and get admire informed opinion from an immigration lawyer - cost you maybe $150-200 for an hour..... But will save you the ticket costs and the stress you and your parents will be till they reach here.... All the best!!
