when you challenge the ticket, you will first be set up in a meeting with the prosecutor. That person will already present you with a deal and you won’t have to justify a thing to the judge. If you still want to fight it then you are scheduled for later. If the trial occurs more than 8 or 10 months from the date of the ticket, you can have the whole thing thrown out because it breaches your Charter rights to a trial without unreasonable delay

I just got an update from a friend in York Region. He had a contested a speeding ticket and was not called for court appointment till 14 months. Out of curosity he contacted the court and found that they had dropped all tickets which were without points (minor offences) due to the huge backlog ........

I got similar ticket, i was driving 45 km over the limit. The cop caught me and gave me the ticket for 15 KM over the limit.

He mentioned me, he is reducing the ticket.

I contact the OTT Legal Services, they told not to fight these ticket, if i fight there are chances that they will reverse the reduce ticket and charge me for over 45 km over the limit.

Update on my case:

I spoke to a lawyer from the OTT Legal services. This is what he told me:

I don't need to withdraw my case. If I receive a court date, just appear in court and "not" contest it - just plead guilty during the hearing in court. They will not reverse my charges to the orignal offense if I plead guilty.

If I do not plead guilty, there is a possibility that they will ignore the reduced fine and try me for the original fine.

By following the above route I have a possibility of the officer not showing up and the ticket thrown away. Nothing to lose.

He also told me that York Region is heavily backlogged and if they havent called you in an year, there is a possibility that your ticket was dismissed without trial. Two more months to go!

Hey G13

Try one thing..........go to web into york region's site (www.york.ca), click on e-services and then for moving violations. There, type in your ticket number (one is a four digit and then the eight digit). After doing it, say continue and you might receive some status update.

This portion is basically for payments of fines, but this morning I tried it with my old ticket for which I had appealed but never got a court hearing date. The response was that there is not Accounts Receivable outstanding for this ticket. you might get the same since I am told that York regions time limit is 9 months.
