I need your comments immediately.
Friday afternoon my wife involved in collision. She was passing through parking lot and the opponents car odessy was backing (reverse) speedily and hit my car. She was in hurry and asked for pink insurance slip from my wife and want to go from the scene. My wife contact me, and i advised her to call police immediately. She called police 911 and amazingly, they said they can't come to private property, take car to collision centre. I towed my car to collision center. My wife had no witness at that time, even odessy driver does not have anybody with her.
I called insurance today and they said as per my information it seems that it's not my fault. They offered me rental car and said they will fix my car even after I have only THIRD PARTY insurance. They said my insurance will not go up. I got rental car today too. Somebody from insurance company will come to inspect my car tomorrow.
Now my Question to worry about is: "Is there a possibility that opponent can prove its my wife's fault?" because she said TO my wife that her husband is lawyer. What happens if she lie with 2-3 witnesses. what do i do?
I m so worried please help me.

Hope everything works out for you. Doubt if any one can predict what can happen.. But in any accidents, the best thing to do immediately is take as many photos as possible.. even cell phone ones will do.

Dont worry too much about the future.
Please follow the following steps - 100%.
1. You already reported the incidence to the Insurance company.
2. Visit the collision center and make the report. Have the date, time and circumstances of the incident noted exactly as YOU/YOUR wife feels. Dont worry about the other party's version. You will need to draw a sketch of the vehicles at the time of the collision.
3. Have the damage assessed and photographed at the collision center.
4. Keep a copy of the report for your own records and note the sr. no. of the report.
5. Pass on this sr. no. to your insurance company.
6. Take the car to the authorised or ins. company recognised repair facility.
7. Note down all costs associated with this exercise, keep notes and receipts.
8. After you get the estimate from the repair center, get them approved by your insurance company and proceed to repairs. If you car is undriveable right away, let the insurance company arrange a rental for the duration of the repairs.
9. Collect the car upon repairs completed. Be sure to test drive the car and check all indicators before taking the final delivery. There is a possibility, the repair facility might have changed some settings during the course of repairs and you might want to report them before taking the final delivery.
10. Most probably the final invoice for the repairs and the rental will be sent directly to your company. However, you send a copy along with your statement of expenses to the insurance company requesting re-imbursement.
Under any circumstances, there is no way the other party can prove that it was your/your wife's mistake, since the car backing out of the parking lot is always responsible to do it safely.
The lawyer (the other party) and/or thier insurance company might call you for a private settlement. In that case, you can either reject thier request or take professional advice.
As long as you have followed all the above steps, you will have no problems.
