I agree that work permit rules are similar in Canada. However, it is not my intention to compare apples to oranges and distort the picture. That IS actually OP's situation. I guess OP is a Canadian citizen and he is going to work in US on work permit. If his status in Canada also is on work permit, then it is apples-apples comparison. However, that is not the case.

Guys ,

An eye opening discussion . Thanks a lot for sharing this info . I have a few qs and would like to put them to the house for common benefit .

Can an EB1 / EB2 Visa be applied for as a Canadian PR ... or is it better to be applied for as a Canadian citizen . ?

Can EB2 and TN work simultaneously ?

Whats the most effective and practiced way to convert a TN to a GC and how much time does it take ?

In my previous post, I was refering to Social Security benefits (the one you get after retirement), not EI.

In regards to EI, a commuter (who lives in Canada and works in US) can claim unemployment from the US as long as he/she has maintained legal work status in the US and has sufficient claimable wages earned in a certain period of time. I believe the link provided by Cdn dude states that as well.

I am not sure how it works for someone who has no connection to Canada (citizen, PR, etc) but lives in US on work permit.

US immigration does not care whether you are PR or citizen. The requirements of the job(education, skill, hierarchy level, etc) is what defines eligibility to file under EB1 or EB2. For instance, in simplified terms, if you have a PhD and if the job requires only a Bachelor's degree, EB1 or 2 may not be possible.

in regards to your comparison of medical insurance.

Think about that you earning $100k / anum, in ON

Your average tax rate would be 28.04%

You rate is little over 8% where I live in States [there are some states where there is no income tax].

so you paid $28000 to get your so called decent heath insurance?

that comes around $2300 / month
Now if you wanna compare apple to apple then pay $2300 / month to your medical insurance company in USA and I can bet that any insurance company will accept any kind of pre-existing condition, even cancer as well.

And don't forget on the top of this you will also get the treatment like a prince of some country.

The $2300/month plan rocks !!!.

As Dimple mentioned, it doesn't matter if you are a PR or a citizen. What matters (in processing time) is the country of birth.

Also, you yourself can't file for a GC under any employment based category (EB1,EB2 or EB3) you employer does that on your behalf.

Yes, but TN to GC is a little tricky. Talk to a lawyer beforehand and he will tell you the intricacies.

Again, depends on a lot of factors like job profile, education and country of birth. A lot of people change their status to H1 from TN before filing the petition in order to avoid that 'tricky situation'.

---I do not understand where this website found these figures and what the "average rate" means. You might want to re-educate yourself by looking at this CRA website that clearly indicates the Ontario tax rates. Based on that, your calculations fall apart.

-- Do not bet, because you are sure to lose. No matter how much you are willing to pay, the insurance companies will NOT even talk to you if you have pre-existing conditions and want to buy health insurance from them privately. They have their policies and they strictly follow those.

You are happy because you got the good rates and that is good for you - but in general what you say about the "better" US system is not true.
