friends:
i was given a ticket in june for not stoping at stop sign long enough. today was my first attendance date. i am going for court trail date and i have been given date in June 2011. Yes right!
How long does one can fight a ticket - 1 or 2 years? I am trying to buy time so that the cop doesn't show up at the same time want to know how long the tickets are valid? I heard from somewhere that after certain time period the tickets become null and void.
please comment.
thx.

Any demerit points remain on your record for 2 years from the date of the infraction .... So if you are able to delay it by 1.5 years , it would remain on your record for 6 mos and Insurance Cos do not raise premium in the middle of the year .....So if you play wisely and have these last 6 mos after the renewal of your insurance , chances are you may have no impact ... neither premium increase , nor demerit points later ....

Fido ..Demerit point start from the day of conviction . If a person is convicted after 1.5 year than the point remain on your records for 3 years after that .
I only wish that your understanding was true .

I think I lost you here - you went for the first court appearance today and got a new date for June 2011? Who requested for the change in date?

Please confirm.

If you requested the new date in your first appearance, then the rule of hearing within reasonable time frame does not apply and you will have to go through the trial, hoping the cop does not show up.

Good luck.

My first attendance meeting prosecutor asked me, do you agree with this charge and I said no. So she said then you would want to go for a court trail. Yes was my answer. She offered me 0 points and $85 penalty. I am trying not to pay anything and routing towards getting the tickets dismissed by buying as much as time as I can. With the delay either the cop wouldn't show up or hoping the tickets to get dismissed itself.

so the next available date they offered me for court trail is in May 2011. Which is kind of good for me. I read somewhere long time back that there is usually a time period they have to look into the tickets. Passing that time, your ticket gets dismissed, null and void.
So what is that time period, does anyone know?

I do not think Law of limitations will apply here as you asked for an extension or trial. They gave you a good offer but you refused it. If the incident happened in Brampton or Kitchener or Waterloo ....I bet the cop will come. My friend got into this at both locations and cop showed up for all dates. There are some vellas.

This is debatable per the following link : http://www.wheels.ca/Auto%20Know/article/627673

'Demerit points are recorded by the ministry after a conviction, but stay on your driving record two years from the offence date – not the conviction date.'

So does it not mean that even if conviction takes an year the record would cease only for 2 years FROM the date of offence . ?
