Hi,

My wife has worked for 300 hours with a specific employer and he has given only 200 hours on ROE SAYING THEY ARE INSURABLE HOURS.

CRA WEBSITE clearly says for people who are hourly paid, insurable hours = actual hours. Even Serv Canada says the same.

Then why such a difference on ROE ? is it some kind of a mistake or a deliberate
fraud for some reason ?

pls advise.

On the ROE there will be a contact address and phone number to report any discrepancy. Ask your wife to contact them with supporting proof of payslips and bank deposits and have it corrected. It will also reflect back on the employers account - he may be penalized .

The Govt office here favour the employee for most discrepancy, if there is sufficient proof. The treatment is fair and without prejudice. Please refrain from introducing the culture of bribing to get your work done - it is not required here for low level jobs. As long as you have proof to support your claims, no one can deny you your rights.

Depending on which city you are in, please register for some anti-TK counselling - if available.

The Govt babus (mostly babes) here work quite the opposite way compared to India - you will be surprised with their efficiency.

Yes we spoke to service canada and they made us write a complaint letter against the employer. Yes we have the pay slips and they checked it an hour back and said the hours on ROE are less and wrong. The complaint letter has been fwd to the head office of serv canada.

The employer, an iraqi, has a white/canadian book keeper for all the salary and ROE jobs.
Dont you think they would have done some kind of insurance before doing this fraud. I mean once we complain they would be under scrutiny for sure and they too know this.

Would service canada/govt resolve this case in few weeks or is it a long process where
we would be called to prove our point again and again.

Did you check with the employer if there was a mistake in the RoE, or straight away went to Service Canada

Sir,

we called the employer. she rudely said dont bother me and hung up. we called her book keeper 4 times left voice mails twice. he never called us back. we waited for his call for 5 days.

then we went to service canada today morning. We have explained the employer from day 1 that we are working only for SINP AND WE NEED ALL THE DOCS LIKE EMPLOYER ref letter, roe, pay slips but everything went to deaf ears. as i have mentioned many times, they did not give the employment ref letter that all employers give. that goes into sinp.

the last pay slip also has wrong name written on it, and then rectified with a pen. I guess intentionally.

NO NO sir nobody is trying to give any bribe. the only thing is that if the book keeper would have said see i cant make another letter for you without fees/money then we were ready to pay him whatever fees he wd have asked for.

Gentlemen, I think we have not done anything wrong by writing that complaint letter and the service agent only at SC office asked my wife to write it.

Bhalochele,

There is a provision of amended ROE for employers to resubmit, So with some effort it will be possible to get corrected ROE.

But

Number of Insurable hours on ROE is not as important as the START date and end date of employment, business number and address of employer is. So you may take extra effort to get the thing corrected but by doing you do not achieve the goal of SINP (which you already achieved by getting ROE).

Think this way, you were so much interested in employer's letter on letter head which as per you 40 other people suggested you is the bible for SINP, but that letter will never have Total hours worked but definitely the PERIOD.

Remember requirement for SINP skilled worker is PERIOD of working on full time offer not HOURS in that period. you may call in sick for example during period of work but that should not not discredit your time period.

You are on right path to get SINP but panicking too much on trivial things..

Bhalochele,

U need a wake up call and need to realize u are in canada, not in india.
Here things are very different than in india and some of the things u would do in india are usually not appreciated here...

e.g. calling the book keeper is not something u should be doing.. , calling the employer again if they have told u not to bother is also something u should not be doing.


Company is not obligated to give any experience or reference letter..

The only obligation a company has to give accurate ROE.

Since u have already contacted ur employer and have not had any proper response , u should go to service canada and ask them to contact the employer to get it rectified.

The employer is legally liable to report accurate hours and if u have proof in some form then service canada will fine the employer.
