Ministry of labor is now investigating, hopefully they follow through on this with rigor. I feel strongly enough about this case that I'm going to write them a letter/email too once I find the right contact information. I'm also planning to write to Shell Canada.
Agree on this being an industry-wide problem, hopefully they can send a strong message by holding the owner accountable if he is found guilty. I doubt he'll be held responsible for the death (that's a bit of a stretch legally), however he can be penalized for employment standards violation - plus there is civil liability if the family sues (which I think they should).
No word from TorStar on the fund - however from the latest updated article below, it seems like Shell is in the process of setting something up so hopefully something will be available soon.

Just attended the funeral at funeral home near Dundas/Cawthra intersection. There were about 150 people attended the ceremony. (About 50 percent were non Indians)
Kudos to MPP Mike Colle who was always with the family since the incident. He helped a lot to the family(not politically but personally) according to close sources of the family.
They have opend a trust account and distributed details at the ceremony. The details perfectly matches with the info given by TK. It is as below
