Will I be allowed to enter Canada?

Hi All,

I have got my PR card in May 2003 and I have not stayed in Canada after getting the PR card. I am now planning to visit canada in June 2006. If I enter in June 2006, I will not be able to satisfy 730 days of physical presence in Canada. So, will I face any problem in the immigration?

Shall I prepone my schedule in order to avoid questioning by immigration authorities?

I don't know but just wondering... when you went out of Canada did they make any stamping on your passport?

Do you know that if you enter Canada by a private car they do not want to see your PR card?

There was no passport control when we left canada . We were also surprised and enquired several people in the airport and understood from them that they donot stamp in the passport. Most probably, they might be having a link with the air lines computer.

But, can some one throw a lght whether I will be allowed to enter into canada under a situation that I will not be able to satisy 730 days of my phyiscal presence during the PR cards validity period.

Go through a Land Border via Car or Bus. They won't even look at your PR Card. Besides, if there is no stamp on your passport, you can always claim that you have been visiting Canada once every 2 months to give interviews / prospect for business oppurtunities and that you have been flying into Detroit (to meet some "friends";) and then driving straight to TO (hence no stamp on the passport). People do it all the time.

it seems your 5-year period doesn't expire until 2008. You've got plenty of time.

If you planning on claiming presence in Canada based on your business/interview trips, you better have proof and compile a list of these activities.

Please bear in mind: Misrepresentation is a serious offence and has severe consequences.

Masood & others please clarify my understanding :

1. Even though Emigration was not stamped in Canada -Immigration must have been stamped when u wud have entered some other country in May 2003 .

2. They can find out from other countries' stamps as per your no. of days spent in Canada over the past 03 years .

3. Even if u fail the 2/5 year deadline they will allow u 2 enter . The problem will come later when some1 tries to validate your PR status and finds that u have invalidated the requirement........... u stand to lose ur PR status automatically in such a case.

4. However even if the Official invalidates ur PR status u can represent ur case in the court of law thru a lawyer pleading humanatarian grounds esp if u have kids and citing proof / reason due 2 which u cudnt satisfy the PR obligations ........... The courts are more forgiving then the Officials .

5. My personal advise - why take a big risk and misrepresent when u can avoid it by preponing by 01 month .
