Q for expert.....if email and letters are spanned over a larger period of time, how does that account for marriage of convenience?

that's very very strong evidence in establishing a genuine marriage. the visa Officer looks at more than just correspondance. The interview is another important tool for the officer to assess the genuineness.

CDs, Allow me to share my experiences with CHC Delhi till now. Moderators feel free to edit if I say anything wrong.
Filled for sponsorship in April 2004 from Canada.
Delhi did not start processing till January 2005 !
Asked for Photos and India police clearance etc 5 months later in June 2005. Did not ask for FBI clearance but I had gotten it so I sent it anyway.
No reply to my queries till Nov 2005 letter telling me I had interview in Jan 2006. By now both medical and police clearance expired.
Letter asking for State police clearance (US) less than one month from interview. Don't even ask what I went through to get it in time. Also got new medical done and new Indian police clearance certificate as old expired.
Day of interview:
The visa officer looked like in a very bad mood. I think she had a cold or something as she was using a lot of tissue. My photos etc were in a mess on to one side of the table. Some of the main Qns and statements which I remember were:
What language do you want to conduct the interview?
If you lie I will refuse the visa. Ok?
Are you married?
Whats wife's nationality?
Her family members' names, birthdays etc.?
Why is she not Indian? (accusing tone)
Why did you go to Canada?
Why did you marry when you were supposed to be only visiting? (accusing tone)
Why didnt you notofy us of engagement? (i didnt know i was supposed to)
Why did you not promptly notify us of the marriage? (i didnt know i was supposed to)
Why didnt your family come from India for marriage? (expenses)
Why didnt you have a lot of people? (expenses)
Why did you marry her so fast? (only 7 months dating)
Why did you leave Canada? (visa had expired)
Why has she not visited you? (cannot afford to spend $2000 minimum)
Im not satisfied that this is a true marriage.
If I refuse dont worry, you can appeal. It will not cost you anything to appeal as its free. (!)
I don't need to see all the photos and read all the letters. You can have them back.
I cannot base my decision on photos, letters, bills, testimonies, joint bank account statements etc. I have to look at the bigger picture which is that you were illegal in USA before you came to Canada.
I have to interview the next person. I will look over your case again and inform in mail.
The next day i sent an email offering more evidence and more testimonials. I got an email reply that even though I had submitted a notorised copy of Marriage Certificate, I need to submit the original and a formal letter requesting it is in mail.
10 days now and no letter. I have sent the Original Marriage Certificate anyway. Will tell what happenes next.
My humble advice to fellow spouse category applicants:
Don't use phone cards to call India. They don't count.
Send letters and email regularly.
Phones are not allowed inside embassys so SMS should be printed.
When you get initial request for photos etc in the mail, make copies and SEND EVERYTHING. Unlike me who sent in around 20 photos(out of over 500) and few select letters. This way you will reduce the chance of interview. Don't send originals, send copies.
Don't depend on them to remember to ask for relevent documents. Send them in anyway. Keep copies.
Get your CAIPS if you get interview letter. (IMPORTANT)
Pray your visa officer is in a good mood.
It does not matter if your relationship is true or not. Its if you can prove it.
I hope this info helps. I will add more as I remember.

oh my God! you've gone thru hell! i wont comment on ne legal issues as i dont have much insight on them and would leave you to the expert's guidance. still man i can imagine how much u've been harassed But i just have one positive thought to offer...it might happen the officer was grouchy at that particular time, and may not actually do wrong to your application. I can just pray for you Bali.....may God bless you dear.
