Again, this section is for people seeking legal advice pertaining to immigration. However justified your frustration is at your friend not getting the visa, it does not belong here! Your response would be appropriate if someone was asking them regarding the morality of their case, but its on a tangent in the context of the question.

So for the last time, this section is reserved for objective legal advice, not judgements and opinions.

This doesn't seem to be the case in most of the posts in this section...Apart from the posts providing patently WRONG advice , there are also many posts which analyze the basic issue being raised. Just do a quick check. You will see what I mean.

My suggestion is to LOCK the posts as you do in the success stories section. But then it's YOUR board..:D

Ladies and gentlemen:

Sponsoring a spouse is legal, not queue jumping. Visa Officers around the world do make mistakes and refuse legitimate and genuine marriage cases too. Simply producing papers, photos, phone bills, videos etc, may not be sufficient to sway an officer at times [actually many times, especially in certain parts of India]. I do at least 2 marriage appeal cases a week and I do not represent people who enter into fake marriages [marriages of convenience].

Belive me, there are thousands of genuinely married people being separated for years because of over-zealous Visa Officers [especially in India].

So, instead of giving the guy a hard time, if you can't offer support, please do not detract from the point at issue here.

He can't appeal until he receives a formal refusal. If the officer indicated at the interview that he/she may refuse the application, it does not harm the case if the sponsor and his wife write to the officer and try to address the concerns raised at the interview [cheaper than an appeal]. If that fails, he will have the right to appeal. If he has tons of emails and sms [and proof of these] and the testimony demonstrates adequate knowledge and a reasonable development of a relationship, I don't see how he can lose his appeal.
