Contract Work for company in USA

Hi,
I am a permanent resident of Canada. My Ex employer in USA is willing to give me a contract opportunity at USA if I can take care of VISA issues.

Q-1) What kind of issues I would face being a PR? Should I apply for H1B to attend this contract job?

Q-2) Do these days in USA count towards citizenship? I expect a period of 3 months
of contract work with travel to canada in between, a few times.

1 - it is upto you
2 - no, unless you live in canada and cross the border everyday

Rajuyathi,
There are 3 options available for you.

1. Apply for H-1B. Waiting time / processing time is approx. 2-3 months in Toronto. The company employing you or a consultant should sponser you for this. Some consultants charge between $1K to $2K for this. Depends on Quota's

2. Apply for a Business visa. The company in the USA where you will work should sponser you. Waiting time is around 2-3 days.

3. Apply for a visitor's visa. Average waiting time in Toronto is 8-10 weeks. People says that if you fix your appointment over the computer at 6:30 am or 5:30 am, You can get a cancelled spot. It is very difficult to get a visitor's visa but if you do get it , then you can work in USA , illegally though.

I am surprised that being in IT and having been in the USA, you donot know anything about the USA employment system.

Note : This is only as i heard from my IT friends. I donot guarentee the genuiness of this posting.

Added note : Unless you are in IT, It is very very difficult to get a H1B or a Business Visa unless you are a highly qualified person. So being a PR, Your options are limited to enter USA.

1 - Only H1-B is applicable, however L1 might be applicable as you worked for that company, however they should have hired you in their overseas branch for at-least a year before applying. You can not get TN Visa as a Canadian PR. It is only for Citizens.

1. H-1B quota is done for year 2007. You will have to wait for another year
2. Business Visa. You are not suppose to earn anything from the USA on this Visa. It is just for making business trips, not an employment trips
3. Visitor Visa. Same as business Visa. You can not work. If you do you may be banned to enter in the USA.

On the business visa there are some exceptions like - you can visit your clients in the usa to support the software or to train them etc. Your company may use you like that.

Thanks Tamilkuravan. You are confirming that H1B is the only work visa. No surprises though, I am not in IT. I wanted to know if there are any special kind of VISA available from Canada to USA (Like TN VISA).
