When we are moving out of India, will we have to show a tax clearance certificate ( Am not sure if it is called that). Basically a document to show that we don't owe any taxes to Indian government.

Please give me your inputs..

Technically, you can be stopped at the Airport and asked by customs for a tax clearance certificate, when migrating. In the worst case scenario, they can stop you from boarding until you prooduce the certificate and the best case would have you 'negotiating' to be let through.

Although, I have not heard of anyone being held back or customs even being aware of this condition, it is good to have the certificate in hand. You need to contact the local IT office. There are many touts hanging outside and you can probably get the certificate in a few hours or it may take a few weeks if you do it 'officially'

I did this in Chennai myself. The dept. is not that dirty. The money asked is reasonable. The person told me to come at 12: 00 noon for processing (at 10.00am). My cost (bribe) :
1. Registration : Rs. 100
2. Cost for writing the certificate : Rs. 300 (After this I was interviewed by a senior officer but who did not ask for any bribe)
3. Friendly tip for seal : Rs. 100 (actually i could have not given it).
I had to come the next day for the seal (which was in another department). I was interviewed by an officer for 10 mins. (he just wanted to kill time but did not ask for any bribe).
Note : This was in April 2002 and it was the busy Income tax filing season.
No one in the airport asked me for the certificate but it was a releif having it.
Rajan D of this forum was asked for it at the airport and he had to pay a bribe of Us$50 or 100 for them to let him and his family board the craft without having the IT clearance certificate.

Sidenote : As Desi#1 says below, This certifcate is not needed with the IT dept. scraping this rule. See the website for more details and take printout of that rule to show to the officers at the Indian immigration in case they try to exploit you. By going through an Accountant in India, YOu will lose about Rs. 2000-Rs. 3000 for this not needed certificate.

The requirement has been scrapped couple of years ago. You do not need this anymore. Check on IT website.

ABOLITION OF TAX CLEARANCE CERTIFICATES FOR PERSONS LEAVING INDIA AND THOSE OBTAINING COMMERCIAL CONTRACTS (ITCC)
The Central Board of Direct Taxes, New Delhi vide Notification No.153/191/2002-TPL dated 13.2.2003 has abolished the scheme of obtaining Income Tax Clearance Certificate (ITCC) applicable to persons leaving India and those obtaining commercial contracts with effect from 1st January, 2003.
The abstract of the above notification is as follows :.
(a) there shall be no requirement of furnishing Income Tax Clearance Certificate by the persons before leaving India; and
(b) no Income Tax Clearance Certificate shall be required to be furnished by any person while filing a tender for the purpose of obtaining commercial contracts, etc.
Accordingly, henceforth, no person leaving India by land, sea or air will be required to obtain a tax clearance certificate and furnish the same to the airlines, etc. except in cases of persons concerning whom the Income-tax Authorities specifically notify the immigration/customs authorities asking that such persons should not be allowed to leave India without obtaining Income Tax Clearance Certificate.

Similarly, contractors shall not be required to get Income Tax Clearance Certificate from the Income Tax Department as there will be no need to furnish such certificate while submitting tenders to Government Departments.

Absolutely not necessary. But, if you want to board the plane peacefully, then better to have it. I was not asked by Customs, eventhough, I had it.
