 L-1 Visa is for intra-company transferees and as such is possible only if the employee worked in the foreign office of the company in US for atleast one year prior to applying for the visa. Given the job hopping climate in India, who ever changed job in the last one year automatically stand disqualified for L1.

Besides L1 Visa has always been a grey area which some anti-immigrant groups in USA claim is being misused by some outsourcing companies since they claim "the transferred employee is not supposed to work outside the company office i.e. at a client's place"

Most small consulting companies and companies in the US that don't have an office in other countries and want to recruit foreign nationals will have to look for local talent in USA or Canadians

Personally, at this very moment , I know a few small consulting companies in USA that have been asking me if there are any Canadian citizens they can recruit for assignments in USA.

Getting H1 has nothing to do with your cdn status - no advantages/disadvantages.
