The guy mentined in the article with out a university degree and is in a job which pretty vauge. I am sure that the employer can find an American to do that job.
The same would apply to a Civil engineer and who is into IT b'cos he did a 3 months Aptech course in Oracle. When this individual tries to enter USA through the border on a TN visa, it is sure that he will be bound to raise some eyebrows of atleast some boder guards. I am sure that all border problems are due to some subjective causes such as this.
For objective people ( Mechanical engineer for a Mechanical job in the USa), I am sure that it will not be much of an hassle./

TK,

FYI: TN does NOT require a labor certification - the process that requires the applicant to prove that he is not replacing an american worker. For TN, you either qualify for it (and hence get it) or you do not qualify (you do not get it).

What is border shopping in this context..

"They (Customs and Border Protection) then accused me of border shopping
and said they were going to put me in jail over the weekend up in front of an immigration judge," said Gibbons.

You try to apply for TN status at one POE, get denied, so you go to another POE WITH the same set of documents and then possibly get denied again and repeat the same at more POEs. The hope is that some POE will overlook and approve the TN.

Unfortunately, the computers are linked and hence they know that you made previous unsuccessful attempt(s). I don't think the border agents frown upon you trying different POEs, but they certainly do not enjoy the fact you are trying at different POE without making any attempt to improve your case (in this situation, possibly requiring the appropriate degrees, but not having them).

Hi Ashwani,

There is not a specific procedure for a specific POE. There are 63 classifications of job titles under NAFTA and you have to apply under one of them that correspond to your education/field of expertise. Each Classification has different requirements and you should have the necessary documents for the classification in order to apply for TN.

At Pearson, the officer took my documents and told me to wait. I waited for about 2 hours and then he called my name and asked me to pay the fee. Same thing happened at Buffalo, though wait time there was 4 hours. So things to keep in mind are have a fool proof TN letter from your employer and carry the supporting documents and dress professionally.

Hope this Helps

TN is an immigration matter - what made you think that it will be done at the airline counter? It is done when you enter the US immigration area at the Pearson and is handled by the US immigration officer.
