Can i take legal action

First of all a word of advise to all don't ever go to a desi mechanic. If you prefer to than get something in written. This is what happened with me. 3 months back i got my alternator changed by this desi mechanic. I told him that i don't mind in paying little bit extra but get me a good brand name. He said don't worry i am going to give you rebuilt and i will support it. I will cover the warranty if something goes wrong. Alternator is giving me trouble now after 3 months and i went today to see this guy. He don't even recognize me and said that i never sold you any alternator. He even said go and do whatever you have to knowing the fact that he never gave me any receipt. Only thing he did was he embossed something on the alternator. I paid him cash. My question is can i take legal action against him. Can i go to consumer court? Again i don't have any receipts or anything. How strong my case is? Please advise.

Normal procedures:
First get a written appraisal. You know the costs. Now you have an idea as to who he is and what he is going to do for you. It is all there in writing.
See if there is a warranty or a guarantee on the parts and labour. If it is only parts then you pay the labour the second time if it fails during the warranty period.

You say that you have no receipt from him for the Alternator or the repairs. Then you cannot substantiate your claim in a court which will ask you for all of these papers. The courts are Paper Based.
He even refuses to acknowledge that you were his former client. That goes to show how mean and shrewd the Mechanic is.

Last but not the least, do you at least have a picture of your car on the hoist or inside of the repair facility with some one working on it?

Your location, it says Delhi. Is it the town and location of the incident? But I sense that you are here.!

If I were you, I will chalk it to experience. But you can put his name on the websites as a Bad Mechanic. Post the same to all of the Bulletin Boards. Also report it anonymously to the Income tax people. Now his goose is cooked.

First, I do not think this is fair to whoever is the mechanic above. Essentially we have one side to the story and the mechanic has no say here.

Second, this is not a forum to adjudicate guilt or innocence - so if the mechanic even posted a reply to the above it would be useless.

Finally, posting the name of the mechanic here has exposed you - dowtrader - to slander charges and punitive damages, should the mechanic be able to prove a loss of business.

I suggest the Mods remove this thread.

First rule, when working with desis, never pay cash. If they don't accept credit card that should ring a bell. Now you know why they don't accept.

Second rule, never try to save on GST/PST(by paying cash), because you'll not have a record of transaction and can't sue.

Third rule, always insist on a quote of the services required. Also check with dealarship what the same service will cost. At least you'll have an idea what the maximum cost of repairs shall be.

Fourth rule, it's not necessary that if you go to a desi he's there to help you. He's out there running a business not a charity service. So always ask about what kind of warranty you'll get and whether he can put that in black and white on paper.

I have got lot of car repairs done by desis but I never pay cash. In US they have a website where people recommend service providers. Say you need a garage, people will go and write reviews about the garage, so that other people can use those services. I had seen a billboard in Chicago last year. Sorry can't recall the name of the website.

May be Canadian desi can start a new section with this kind of a service. If not I can start one. Any volunteers?

It's shame that hum (desi) nahi sudhrenge . It's all part of the sab chalta hai mentality. Chor chori se jaaye pur hera-pheri se na jaaye. Sorry it happened to you. So now you know how to deal with desis.

Thanks to everyone for their valuable input except Big vee for the useless comments. I don't care. I will keep posting this mechanics name on each and every website that i come across to alert and prevent others. I took a hit and have very unpleasant experience. This is for the first time that i dealt with a desi mechanic. For the information of everyone i paid the taxes and didn't get any receipt. Can you believe that? I asked this scammer to give me a receipt and he said that he is out of bill book and will mail me one when he get it next week. I expressed interest in paying by debit or credit card so that i have something as a proof and he denied it. I called him a week later to confirm when will i receive the receipt and his reply was don't worry i am behind my product to support. I didn't realize that he is a cheater. I am going to take legal action anyways regardless of outcome. This is the question of ethics not money. I want to prove him that I am not an illiterate Jat or somebody from pind who he can make fool so that he won't do it to anybody else.

You may not like what you read, but BigVee has a point. In fact, there are three sides to a story - Yours, Mine and the Truth. And it is one person's opinion here, not a general consensus right? Think about it.

On a side note, you really haven't named names have you? :) That's good.

Finally, go to reputable places for car repairs. In fact, I learnt that the Midas location at Eglinton-Dixie in Mississauga was a great place from my fellow CDs here. I went there and indeed it was a pleasant surprise. Were they a little expensive? Yep. But hey, at least I am not going through what you are going through.

Saving every damn penny, cutting corners etc also is "desi mentality". I still see people here asking for a "desi mechanic"? Why? Beats me...
