I have just returned from the Immigration Settlement & Adaptation Program Office in K-W. There I spoke to a lady (who deals with new Indian immigrants)about the Residency Obligation Rules appliacbale in my case (Arranged Opinion of Employment) and I also showed her the Sheet which reads what I have already mentioned in my earlier post.
The lady says even if I will have enough time to make the 730 days before the 5-year mark, I may still be stopped at the Airport if I try to enter next time which will be after two years outside Canada. Are there cases of this nature?

I have also written a letter about 2 weeks ago to the Case Processing Centre in Sydney NS with copies of my PR card, the "confusing" sheet and information sheet which I received with my PR Card which also says that one need to stay 730 days in canada out of 5 year to maintain PR status. I have not received any reply so far. My idea was to have something in writing from the CIC.

I will be leaving Canada in about two weeks time and would like to be 100% sure as to what is what? Please help.

I don't understand what the fuss is all about.
What is it about the 730 day rule that you do not understand?
It is a very simple rule - 730 days in every 5 year period.
Of course, you may be "stopped" any time by Immigration when you are entering Canada.
They have the right (and the duty) to question everyone and determine whether they are meeting the residency requirements.

The part in your case I am not sure of is whether it is ok for you to not take up the arranged employment on which basis you got PR visa.
If that arranged employment gave you the points you needed to meet PR visa requirements, and now you do not take up the employment and go abroad to take up some other job, I don't know whether that's a violation of your PR visa conditions.
That is the question you need to ask CIC.

Thanks for your reply.

I could not take up the employment in 2007 when I immigrated because of the time constraint and my contractual obligations with my employer outside Canada. (A lot of terminal benefits were involved). In doing that I missed the arranged employment here as I could not get extension this side.

Let me wait for the reply from Case Processing Centre. Are they the right people to contact to?

No.
Call the CIC Call Center @ 1-888-242-2100
There is an option for PR questions.
Then select the option to speak to an agent.
You may have to hold for some time but eventually they pick up.
Thu and Fridays are usually the best days to call because of low call volume.

Thanks.

I am a bit worried. What exactly I should ask? Just about the rules for the residency obligations. I do not want to unnecessary blow up the situation. My concern is more about my kids who are at the Universo]ities here. I do not mind even if I am not allowed to re-enter. I do not want them to be affected in any way. The way I know it that there is no difference between the landed immigrant. Whether you came on arranged opinion of employment or atherwise. My main concern is on the 2 years or 3 years so that I can plan my future activities.

But they are already here and living here.
As long as they don't leave again and stay out for an extended period of time (thereby abandoning their university study), there is not problem.
CIC isn't gonna come and kick them out of the country for no reason.
