PR application with or without arranged employment

Hi,

I am getting 65 points by self assessment test in Canada Immigration website without arranged employment (10 points). I would like to know whether I can put arranged employment points as my work permit is for 6 more months only and they say in one of their requirements (C)
for arranged employment points that

A. your temporary work permit was exempted from the requirement of
obtaining a labour market opinion of your job offer from HRSDC on the
basis of an international agreement (e.g., NAFTA or GATS), a significant
benefit to Canada (e.g., intra-company transfer) or public policy on
Canada’s academic or economic competitiveness (e.g., post-graduate
work);
B. you are currently working in that job;
C. the work permit was valid at the time you made your permanent resident
visa application and at the time the visa, if any, is issued; and
D. your employer made an offer to employ you on an indeterminate basis
once the permanent resident visa is issued.



I have been working in Canada on a temporary work permit for the past 1 year and I can try getting an indeterminate offer letter from employer.

Please give your suggestions...

IMHO I would suggest to you that you apply for your PR through arranged employment. Just for a few simple reasons, one is, they will first provide you with the assessment, then they will top it with the extra points to provide you with a few more. Now if you have failed to note or evaluate correctly, they will do it based upon the fundamentals first. They have worked for you before, because you are here in Canada already based upon the fundamentals. I hope you have noticed that fact and not overlooked it.

Then, having worked in Canada and establishing your self very well would give you an edge in your new application. That is a plus.

Last but not the least, you are now getting a letter of employment in the interim, from your current employer and he is providing you with on going support with employment. This will keep the Immigration department in the LOOP. Now they are also involved in it and cannot say that they did not know about it.

For your protection, please obtain the copies of all of the correspondence from your employer and retain it for the future. That will avert any set backs, if there are any delays in processing.

This does not absolve you from your duties of asking for an extension in case your current visa is expiring. Extend it for as long a period as you can get from them based upon the work permit they are willing to issue to you the next time. Because you know it will take a couple of years or thereabouts for the process to complete.

As for 'a' you will have to consult the employer and the CIC to see if the current employment was exempt from LMO.
for 'b' , 'c', and 'd' the option seems to be 'YES'.

Since your application is for Permanent Residency and is applied by you, you will have to wait for their acknowledgment first. Once you have a file number you can heave a sigh of relief and settle down in your job and continue safely. But don't forget you still have to obtain an extension of the work permit till everything falls in place. The onus is upon you to maintain the continuity in your VISA till your PR.

Thanks a lot for your reply and suggestion. Regarding job extension letter, since they asked for 'indeterminate letter' hopefully I can get one saying that my work permit/job can be extended etc. Will apply and wait for the acknowledgement letter then.

hi i am a visitor her in toronto i was woundering as i have a 10 years of b1b2 visa of usa and i have plannes to stay here by arrange employment but for that i have to pay money to a agent if in case some company will offer me a job then can this company go for my pr my email id is

As a visitor in Canada, you can look for prospective employers and also go through interviews with them. Get selected for a job and apply for a PR too. But you cannot stay and work here on that VISITOR's VISA. It is 'illegal'. If they find out, you are in a lot of trouble and could be barred for life from entering Canada.

There are some jobs that do not call for Labor Market Opinion, which is the approval from the Immigration Department. That does not mean you can get in freely. Because you have to apply for your PR to them. They are thee same people.

Since you are in the USA on an H1B, you can obtain visitor's visa and travel back and forth. Your employer, the prospective one, can apply or provide you with an employment letter and also obtain the permit for you. That process is called getting a work permit. Since you want to get in here into Canada in a hurry, your employer can help you with the proper procedures.

YOU have to be able to do all of these and see where the employer can help you.
First is the application for a work permit.
Then the Employment letter with the proper classification and the LMO.
Then you have to get all of the qualifications verified. Your recommendations and references from the previous employer/s. Verification of your certificates and Licenses.
Your personal Police Clearance Certificate from your country of residence. Then the PCC from USA (FBI) and the State that you normally stay there in the USA.
Proof of your financial standing.
Your Medical Examination.
Then an interview with the Immigration Department.
When you get through all of these processes, it could take well over an year or more. It all depends upon how well you are prepared so far.

Since all of these could be done by yourself and you know the job you are trying to get into, you don't have to pay anyone to do this. Because you are doing 99% of the work by yourself.

No one offers any job to people without doing all of the checks and interviews. "Your e-mail will not get you any response". I don't want to discourage you, there are places where you can post your CV or search for one that is suitable to your qualifications and level of experience and see if there are any hits. Who knows! you may start a trend.

See if the above gives you an idea as to what it calls for and how well prepared you are.
