Canadian Citizen marrying Indian Citizen

I am a Canadian Citizen.

I want to marry a Indian Citizen.

The marriage would be a registered (court) marriage in India.

if my wife wants to join me in Canada what is the procedure ..

she is a divorcee (legal divorce has been completed about 5 years ago) in India with a son (legal custody of her son is with her) whom I am also planning to sponsor and complete the adoption procedure later ...

Need some pointers on how to go about with this .?

First and foremost, please get the Divorce Document double checked and make sure that there are no restrictions or any hindrances in your moving out of the country with the closest family. Please pay and see a lawyer there.

Since you are located here in Canada, please meet with a Canadian Immigrant Help Center, closest to where you live, with the available information and documents that you currently have on you and get an application filled out while you are here. Since they have abolished the fiancee class for a while now, carry the application with you and file the papers after the Marriage.

Keep a record of all of he happenings with the appropriate timings from the time you decided to meet and marry. Also go through the other e-mails with all of the information at the archives.

Thank you very much for taking the time to reply to my query.

1/ So assuming that the divorce documents are clear ..

2/ I get the proper documentation for marriage from Canada .. (“Statement in lieu of Certificate of Non-impediment”)

What is the expected (current) delay after the marriage for my wife to join me in Canada...


Also does the procedure change if I am currently not in Canada (I am working in USA .. But I have a house in Canada and pay my taxes in Canada).

There are times that I would like to consult some one in the know how of the field, just to get that piece of mind. You know what happens when you and me assume.

The priest who performs or the judge that does the registry should be well qualified and his signature should be in the registry. It should first conform to the locale, where ever you are conducting the ceremony.

Get the Wedding Invitations done. Make a guest list. Have them all assemble in a location where you all can get together and take a few pictures and a video. Ask all of them to attest a book as token of their visit. Keep all of the expenses accounted. Where ever you spend your honey moon etc., documented. There are many a tips that have been posted here on this CD for all of them who are getting married, who are going for an interview and those went through the process, if they have gotten back and posted their experiences etc., It is well worth a search and jot all of the points down in a numerical order and follow them to the end. You have ample time and do the spade work and get on top of it. You can obtain the Canadian Marriage Certificate here after landing here together, if found necessary.

The process is the Same as regards where you are living. Now the next question is: "are you a Canadian Citizen" or have you applied to become one? If so how long a time to go for the swearing in ceremony? If every thing falls in place, then, you are well on your way to getting settled here. Where you are currently becomes a factor, if you don't have a mailing address.

Either you have to be a Canadian Citizen or be residing here when applying for her sponsorship and be there when she arrives here and receive her. But if you have your Canadian Citizenship, then it is a different story...

Standard processing time is about SIX months. But if you are not on top of it, with Passports, Police Clearances, having the application ready etc., then add a few months to it. Also pay the fees up front, which might save you a week or two.

Since I have a house in Ontario I have a Canadian mailing address too ...

2/ I am working in USA on H1. (pay my differential tax regularly in Canada)

3/ So I could get the necessary documentation, arrange for the h4 visa for my wife and dependent son.

4/ Once in US we can then work on the Canadian Immigration part once things settle down a bit.

Is it not necessary that the sponsor should live inside canada to sponsor a family member???

1) You are correct. The process is : You can apply from any part of the world, if you are a Canadian Citizen. Please accompany the sponsored people or receive them when the application get approved and they are landing here in Canada.

2)There is a treaty between Canada and USA to tax that person only once. It is a subject matter that needs discussion. It is too long to go into detail here. (DTAA)

3) Yes. You could do that also and then apply from USA.

4) No. It is my opinion that the financial troubles plaguing USA might not give you the ample time that you are looking to get. You might find it too short to accomplish the smooth transition that you are trying to accomplish.

In short, do it as soon as you can. That way when the approval comes through you can take a small break and enter with the family here and return. Thereby you establish the PR Status for them. When you do so, the family benefits with the time they spend with you anywhere you are employed and working. The ball is in your court, so, You be the judge.
