My Nephew is a Canadian citizen who got married to a girl in India, applied for her immi. and the girl is now in canada for last 6 months. Marriage is not working out and they are getting divorced. Once paperwork is done, he wants to send her back to India as well as cancel her PR card/landed immigrant status.
I was wondering if you could please tell us as per govt.immi. laws, can a canadian citizen cancel his spouse's PR card and if yes, what is the procedure.

If he (the citizen) has signed the sponsorship form (i.e., agreed to sponsor her for a fixed # of years) then you can submit submit some documentation to the Govt. stating that you are not going to fulfill the commitment of sponsoring. Then they can look into the matter. I dunno if this will affect your chances of "re-sponsoring" someone again in the near future.

There is difference in NOT being able to fulfill sponsership commitments and getting the PR revoked.
There is never any problem with the first one, divorce takes care of it autmatically.
BUT once you land and acquire permamnet residence status, it can not be revoked unless there was a fraud invloved.

CPM pls read my stuff . I never spoke abt revocation or anything. I said that the concerned person *has* to inform the authorities that he wont be supporting his ex-wife ! This may be double edged sword.. If no pre-nuptial was signed then the wife is entitled to seek legal remedy for alimony and worst case scenario - jaydaad ka hissa .
I suppose Masoodji would be in a better position to answer this point (the question of revocation)... My guess... only the Govt. can revoke a PR status...individuals cant

Yes, once the paperwork is done and she is gone, my nephew is definately coming back here and get married and apply for his 2nd wife's immigration.
Hope all this is possible as per canadian laws.
