I am in Canada right now with Permanent Resident (PR) status. I entered in Canada on Jul. 20, 2003. I have got 5 years multiple entry visitor visa for USA in Aug. 2004 and I have been in usa for three times. I have got offer letter from one employer located in Chicago (Java based software developing Computer Company) and they want me to start the job from Feb. 14, 2005. I have come to know from some sources that American consulate is not accepting H1B application until Apr., 2005 and will start issuing H1B visas from Oct., 2005 as they have lot of backlog for H1B category. I would like to start the job as soon as possible.
• Can I apply for TN-1 visa?
• I am having Indian CITIZENSHIP and Permanent Resident (PR) status in Canada.
• Is there any other way to get me work permit for USA as soon as possible?
Please let me know if somebody has this information. Basically the employer forces me to get TN-1 visa and I am not sure whether I am eligible for it or not.

Hi Brijesh, you are not eligible for TN Visa - Canadian Citizens (not PR) can work under the TN Visa. You need an H1B Visa to work for in the US - the H1B quota for this year has been exhausted and the quota for next year will start in October. Petitions under the next year quota will be accepted from April 1 2005.
The only people who can sponsor an H1B Visa currently are educational institutions and government departments as their sponsorship is exempt from quota. So if your employer fits in one of these categories, you can ask them for sponsorship (a Java based software developing Computer Company doesnt sound like an educational or government organization).
Failing an H1B Visa you can work with the company remotely from Canada. If they have an office in Canada you can work with them for 1 year and then seek a transfer to their US operations under an L1 Visa. An L Visa may be preferable to an H1B Visa if you are seeking permanent residence in the US as you do not have to undergo labor certification. However L1 Visa has other constraints.
