Hi,
I am working in US on H1B1 visa. My 3 year time away from Canada ends in October 2005. However, I would like to continue working in US after October 2005 without losing my Canadian PR status. Is there a posssible way out?
The nature of my work (structural design and construction inspection) would require me to live and work in US. As I am in Chicago area unlike Detroit I cannot commute on daily basis from Canada. Can I register a firm in Canada and get payed thru it ? I would then be not working directly for US employer but as a subcontractor to the US employer thru Canadian firm. What kind of taxes I become liable for ? What kind of visa I would need to work in US ? Would it effect my Canadian PR status?
Any comments or suggesstions please...
Thanks,
Shagufta
Your time outside Canada as an employee of a Canadian company is counted as time IN Canada. However, if you set up a company and be employed by it to work in the US, it will not count as 'being employed by a Canadian company'. The law specifies that such arrangements are 'convenience arrangements' and do not count.

Thanks for your response Mr. Massood. I suspected it might not be so easy. However, I have to plan some stategy if I don't get a job in Canada. If I do get a job in Canada I'll just pack up and move immediately....
Hi Massoodji
Thanks for your answer. I have same question, but for applying canadian citizenship.
Let's suppose if you hve been employeed of canadian company and you are working in US.
1. You have to get Visa, to stay in USA , right? Because now you can not travel or cross border if you have canadian immigration, you hve to requried to get USA visitor visa. And under vistor visa you can't work in USA.
I don't have any US visa (like h1b), then in that case I have obtain H1b to enter in USA.
2. When I apply for canadian citizenship, dose it going to count that period IN canada? Means am I eligible to complete 1095 days..even though i was outside of canada but i was employeed thru canadian company.
Please give me answer.
Thanks
