forum while going through a thread ...an applicants file was rejected as CIC gave zero points for age.. that particular applicant is only 47 yrs...they gave him 5 points instead of 10 for the job offer in canada....my question is>>>>is the calculation of the points is done according to the chart in CIC website??or the calculation is done according to the the mood of the visa officer???im a 2003 sept. applicant....its the first time i have read this type of case in the forum...one has to wait for over five years for his/her turn to come ,and in the end it is the mood of the visa officer that really counts

No its definately not on the basis of the mood of visa officer... there is a clear cut selection grid provided by the department of immigration. if any visa officer has failed to provide relevant points for age and has rejected a case on that basis, then the applicant may prefer an appeal.

the applicant file has really been rejected as he was above 47..it is a fact...where is the question for appeal?...when the chart shows 41-49 yrs....he was rejected purely on the mood of visa officer....can anyone else put light on this????

how can i give you proof here????....only proof is i have seen the CIC paper with my 2 eyes...im not getting any pleasure in giving false information here....im concerned as im 42 myself and im also concerned for other too...who are 40 and above
Suitability is the only factor on which the Visa officer has discretionary powers(if suitability -10 pts are still there as a factor ) . if you are 100% sure that someone has been marked incorrectly against the prescribed criterions - feel free to appeal -- it might be an oversight .

As mentioned earlier, preferring an appeal is the only option left with your friend. In legal language it is called judicial review.
