Hello All:
I got as Speeding ticket. I was at 115 in a 80 km/hr zone (so the officer said). He reduced it to 109 km/hr to bring it to 29 km/hr over the limit. Got fine + points.
I know I was speeding, and was wrong but the issue is now I want to save the points. I have read the old threads …
Q1 What should I say in court, yes I was speeding, but reduce my points or I was not conscious of speed or people were tailgating in one lane highway…and overtaking (which was true) …what wud work ?
Q2 Is it true that bcos officer had fined on reduced speed, fine and points might actually go up In court ? that’s what officer told me
Q3 The officer was in a normal car, not police car, he was driving from other side towards us, can he catch speed on radar / laser in a driving car ? He gave tickets to all 3 cars, mine and 2 after me
Q4 Does it matter, he put old address of mine on ticket…although all documents I gave him had updated address ?
Q5 I am opting for option 3, which is requesting trial, (on my own, no lawyer)
Should I tick off on want to challenge officers evidence and want officer present in court ?
Should I tick off want to plead not guilty?
I know what these 2 mean, my question is more like, which one would work in favour, ticking or not ticking?
Q6 My insurance got renewed recently, wud it affect my insurance this year ? wud it affect my insurance next year ?
P.S. : Officer’s lies : I did not check your old record, yes u did or how will u get my old address ? U get 2 point, no it is 3…points go away in 2 yrs, no it is 3 yrs.

Sorry to hear that you got the ticket.
Although I am very much supporter of fighting a ticket, since most of the good drivers get caught for some silly mistakes. but 35KM/h over the posted limit of 80 KM seems to be deliberate. Also it was not a speed trap. The chances of judge siding with cop are more and may in fact result in same or more fine. But again I am no expert. I would advise to go thru those para legals if you really want to contest. They may get the points waved but may have to pay the fine.

Q1: Were you overtaking other vehicle in dashed lane? or other vehicles were overtaking you? Is this your route where you driver regularly and that is the speed you typically drive there? Was it a sort of race between these 3 vehicles?
Q2: It is possibility if officeer proves the speed with radar etc.
Q3: No Idea. It is kind of unlikely that an officer would fine 3 cars without substantial proof.
Q4: Good question..may be paralegal can help you on that one.
Q5: Tick off plead not guilty
Q6: Insurance does not affect till you are proven guilty. Also in most of the cases the change in premium happens during renewal (sometimes they do not even run history during every renewal)

Just out of curiosity, how did he manage to get all 3 of you? Just stopped his vehicle in front of your car and then ticketed 2 vehicles behind you?
I was in the same situation in 2009. I hired a paralegal with the promise that the ticket would be thrown away. However, they did nothing. I paid the paralegal, paid the fine and the points still remained.
However, there is a lot of sucess, if you defend yourself in court. Searching in Charcha will help you (esp. Hiren's/Fido posts)

This is from my experience in going to court in Windsor on behalf of my wife's tickets (yes 3 of them - 2 from Windsor Police and 1 from OPP).
In all three cases:
Trip #1 - to file a form requesting an appointment with the prosecutor.
Trip #2 - See the prosecutor for 3 minutes who reduced the fine and removed the points, wait for 30 or so minutes, appear before the judge, agree to pay the reduced amount, pay the amount and walk out.
Our insurance did not go up and I don't know if the insurance company audited our records during renewal or not.

Thanks all, I was on same page after some research that fines wud be reduced and points withdrawn should be a good deal, but web sites show other wise. They say it is either guilty ot not guilty even if u have no points in terms of impact on your driving record for 3 years and insurance records..

no one was overtaking although some vehicles did over take me earlier.no race. thats not my regular route
