Isn't it a right of a returning Canadian citizen to be covered by OHIP once 3 months period is passed?
Why u have to fight in the court for every right u have. Appeal is only required where the matter is not clear. But if u are Canadian citizen and is denied for any OHIP coverage then it is totally a joke.
so the only recourse is to get a lawyer?

I did not want to repeat my question. Did you apply before your stay of 3 months in Ontario were over? In that case, they could simply decline saying that you have not fulfilled the criteria.
Are u still a citizen of another country? I think it is complicated if u are a citizen of other country than you are not entitled for many canadian citizen benefits. This is the reason why many people are hasitating to take OCI instead people are opting PIO card as a better option. Better you get a legal advice.
Anyway, even if you are not eligible you can contact community health centres they provide free services to those who are not eligible for temporary.
To the OP: Were you given reasons for your denail of coverage under OHIP. Surely they must have told you something as they simply do not deny coverage for no reason.
To chekram_04: Whether one has dual citizenship or not, it does not matter. For OHIP, they look at your status (Citizen or PR) and whether you have met the residency requirements. http://www.health.gov.on.ca/en/public/programs/ohip/ read under eligibility. And by the way, OCI is NOT dual citizenship, it is often wrongly mischaracterized as dual citizenship because of it's name.
