Thanks for all your guidence, I landed in canada, did the renewal of my license , OHIP and other stuffs. sending application for my PR card renewal.
I have the following question.
As I have already stated ,
Me and my wife livied in Mississauge since 7th nov 2001, having PR , went back to india on aug 2005, In india we had baby boy on july 2006, In 2007 we decided to return back to canada, I applied for my son TRV during 2007 , three times got rejected stating that both parents are PR. we put a hold on moving back to canada.
In 2008 onceagain I got very good oppurtunity in canada ,So I decided to move first .
Now I returned back to canada with Travel document( having fulfilled PR residency Oblication in past 5 years ). I defenitley have to apply for sponsor ship for my son - there is no doubt about that.
My question - for my wife,
As my sons TRV rejected three times ( I have the papers with me )in India, she can not travel to canada leaving my child in india , she has to stay back india untill my son gets his Sponsorship . But during that time my wife might have exeeded her PR residency oblications( 730 days presence in canada out of 5 years past )
Does my wife get any Humanitarian and compassionaate factors for her PR retaining ( she can travel with travel document along with my son ), if that is so in that case I do not need to apply for her Sponsorship.
Let me know any one has undergone the same situation. let me know any complexcities and advantages. Your timely help for the above will greatly appriciated.

Thanks, for your reply, My wife's PR card already expired on feb 2008,. We already applied for son's trv got rejected 2 times.

As far as i know Once u renew PR card the 2 yrs in 5 years does not reset.
What does that mean..
lets say u were resident of 2 years followed by outside for slightly less than 3 years , return and renew ur card and u leave the country and come back after lets say short period that kicks ur counter above 3 years in 5 years u could be in voilation of ur residency obligation and may have a removal procedding after u reenter..
Becareful while trying to cheat the system..

You and your wife landed here in Nov 2001. You both lived here for 3 Years and 9 Months. You did qualify to renew your PR Card at the end of the year 2006. It is the middle of 2008 now.
Your second Five year term started Nov 2006. You have time till November of 2011 to fill in the required 730 days. So, apply and get a Travel document and also obtain a VISA on your Son's Passport for both of them to travel. After they both land, please apply for a PR Card for both of them.
Now that you are settled down here and living in Canada, try and meet with the people at the Immigrant Help Center and ask them to help you fill out all of the forms for your wife and your son's travel into Canada. While you are there at the Center, please get your PR applications for your wife and your son also filled out and keep them handy.

From his first post quoted above, Mr. Krishnan Stayed here for 3 Years and 9 Months.
He applied for a travel document and he arrived here, He was away from Aug. 2005. He is back and resuming where he left off.
His wife also applied and got a Travel Document. But she is waiting for their Son's Visa and then she will travel together with their son. The period extended to him is not long enough for his son to get his visa stamped. So she extends or reapplies before the expiry date.
Mr. Krishnan is now here. If he wishes, he can apply for the Canadian Citizenship. He also could have done so even in his previous five years' stay.
All he has to do is apply a second time for his wife's travel document or extend the same and get it, and then travel. After that they both rejoin him.
Where did you hear that the second five year term does not exist? If it does not, then, can you tell him, how many days he needs to fill in? and how many days out of what period in length to renew it?
There is a validity date on that PR card as noted on the back of the card. After which he needs to renew it. And to renew it......
I don't see any difficulty in reading this.
