Hello Massood,
My parents applied for their visa in Jan 2003 in response of which CHC India issued a letter that the case will be cleared in one year time.
Now, I have been checking status by asking for CAIPS notes from time to time and found that the file has been pushed to future date. Initially it was May 2003, then to Nov 2003, then to June 2004, then to Dec 2004 and now to May 2006.
My Q to you, Is there any way Federal Government tackled in Court of Law on basis of initial letter issued. They had given estimated time of clearance of application or decision within one year.
What are chances of success to get an Court Order to push the Immigration Department take up the matter immediately?
I have paid ROLF in advance in October 2002 when I filed sponsorship application.

I dont think you can take the matter to the court as long as the word "estimated" has been used in their statement.

I also agree with you, but Can "Estimates" be unreasonable?
One year can be plus minus six months or it can only be plus three years?

It can be anything, an estimate is an estimate, you cant hold someone liable for it.
I am sure, there are some additional statements the CIC have mentioned on your papers, to keep themselves safe from liabilities. They are not in their first year of immigration.
