Hi..I was wondering if a marriage between a Hindu man,and a Christian lady was valid,If they got married, and they registered thier marriage under The Hindu Marriage Act 1955...Would thier marriage be valid there in India??..
HMA 1955 is not applicable to Christians in India.
Best for you to be married under Special Marriage Act of 1954. This Act permits marriages between persons who are not of the same community or who have different religions or nationalities. The scope of the Act includes the entire territory of India and extends to intending spouses who are both Indian nationals living abroad. The groom must be at least 21 years old, while the bride must be at least 18 years of age.
I am not qualified to practise law in India. Therefore, for greater certainty, I would strongly advise you to seek legal advice firm a lawyer who does. My suggestion above is what I have learned from years of experience in Canadian immigration law and my interaction with Indian lawyers & cases involving marriage etc.
