i have a very unique situation. I am a Canadian Citizen working in the US on TN visa. I am classified as Non Resident, i am wondering if its possible for me to apply immigration for my mother.
I just changed status to non resident in Canada. Is it possible that i can apply for her immgration
If so what is the process? Is it the same forms as if someone will apply as resident?
She is in Pakistan, does anyone knows whats the time frame now a days?
Please help me with this
Thanks
A Canadian
Just to let you know the non resident means i don't have to file taxes in the US since i am already paying taxes in the US>
Thanks
A Canadian citizen can file for parental sponsorship if he is living outside Canada. However, he must have intention of coming back to Canada when his parents have gained the PR, as he has signed an agreement to support them for 10 years.
There is less chances.
I was in same situation 3 years before and my lawyer has suggested not to move in US at all.
Lawyer has suggested us that firm will be not responsible for denial. And Firm will not able to fight agaist denial as with this base they can deny visa.
So I guess that it is hard. I have sponsered parent and brother and we did not have any other things that she had warned us.
If you can take risk, I would say you can go ahead. if you don't depend on it.
sometimes, it depend on paper also. try to search for good lawyer which can take your case and promise for success.
or else if they deny, you can come back to canada and stay here so residency requriement will statisfy.
For my family, immigration was more important than I do job in US, so I stayed here.
Thanks i guess other option i have is to work in the US pay taxes in the US and then file Taxes on 28500$ in Canada cough up 6k and apply for my mother.
I guess i have to take this pill and file taxes in the US and Canada
Anyone else have any suggestion or in this situation?
Thanks
Filling tax on both side will not satisfy sponsorship requirement. I had bought house here in canada to show the tie paying property taxes etc and paying taxes in canada and USa..but lawyer told me that the sponsorship requirement states about physical stay required for sponsor.
It was made very clear by our immigration lawyer... Our immigration lawyer is main chair or immigration bar association..and no.1 firm in Ontario. The lawyer had more than 15 years of exprience working in immigration department making policy.
So lawyer told me that, you can file but if they deny visa..lawyer can not fight as we are not meeting the guideline so lawyer can not promise to fight back.
I hope I made it clear.. if you stay here in canada and if you satisfy minimum tax requirement for sponsorship.
I would suggest you download sponsorship document from online immigration website and read it out.
It metioned very clearly about 'physical stay'.
I was in same situation before 2 years back...
Umm my neice is also in Canada and i guess she can apply for her grandmother, is this possible? She lives in Canada but does not have a job maybe she can fulfill minimum requirements?
Is this possible.
One question how much time does it take to bring your parents or grand parents?
Thanks
