My frnd landed here in Canada in May 2004 with his family, got their PR Cards and moved back to India after a few weeks with his family, for long period.

1. He is getting CCTB money into wife bank account, would there be any problem later on for PR Status or Citizenship for them ?

Please advise me to help him ?

He will/might not have problem with his PR or citizenship till he maintains his residency as per requirement (2 of 5 years and 3 of 4 years for PR and citizenshp respectively), but he will definitely have problems with CCTB since he, or rather his wife in not entitled to receive the CCTB if the child is not residing in Canada and they fail to disclose and keep pocketing the amounts received into bank accounts.

Sure he will. I personally know some guys who came here, stayed couple of months, applied for CTB nad went back back home. Now CTB is directly going in their bank account. To receive CTB in next year he he and his wife have to file their Income Tax Return. They can do it over internet.

Once they come back than they have to disclose the residency gap. CTB than has to be refunded back. I know one similar case where the family had to retun the money.

BTW, it is shameful for the family who is doing this knowingly and have gone back.

I know this is very shameful to misuse the CCTB facility. But do u think someone who has returned to India will even think of saying NO to a free fund of around 5000 rupees ( at an average of 150 C$) every month ?

The couple in question is inIndia and do not wish to return by 2005 end. I think the funds have not started coming into the mothers account so far.
But may be within few weeks it will be there in her account.

I am glad that Canadian authorities have some mechanism where in they can claim the amount of CCTB back also.

In view of your knowledge of a similar case, can you present a generalised summary so that other people who intend to misuse the facility may be warned well in advance.

Please suggest !

Let us try to educate people so as to enjoy Canadian facilities in a proper way.
