Oct/Nov 2001, Country2: I am an Indian. I had been working in this country for six years. My neighbor, also an Indian who filed his immigration papers 6 months before was about to shift to Canada.
Few days later one my colleague had resigned to his job for Canadian immigration. Both they went through two deferent consultants.
After long discussion among us- my wife and me had decided to apply for the immigration. One main reason is education of children. Chosen the same consultant of my neighbor since he is present worldwide with HO in Canada.
It started as a simple query to the Consultant -resulted lot of replies, follow ups, Several Phone calls pored in. We were impressed their speed, language, follow up and assurances of pre and post landing services. Also we were told the urgency of the application since the amendments to the immigration rules could take place any time. I paid USD 3000 up front for the immigration as consultant charges.
April 2002: My application was filed in the nearest Canadian High commission in Country 4, after two weeks of sending the papers to him. I was of the opinion that he might have scrutinized all the documents before forwarding to CHC. He has acknowledged the filing the case and I was informed that the new rules likely to come in future would not effect my case. Normal time of completion of immigration is 18 months in the country where it was filed.
May 2002: I returned to India for good. Informed the consultant about my change in employment status. I was unemployed searching for a new job.
June / July 2002: Learnt that the new rules were set in. Gone through the new rules in the Internet. Realized that I was effected. No information from consultant. Since I was unemployed I had plenty of time to go to school to learn French together with Wife. Both of us enjoyed the French classes with boys and girls half my age and reinvented my youth. Mean while I gave the IELTS. I would say this is the best period of my Life
Aug 2002: Consultant sent me the file Number issued by the CHC.
Nov 2002: CHC returned the DD and asked to replace with a new one. I was informed by the consultant the need of learning the French and need for IELTS.
Meanwhile I got a Job offer in Country 3.
Jan 2003: Joined in new service in Country 3. Informed the consultant regarding the new employment status.
Feb 2003:Consultant had sent me an email and asked me the need of the resubmitting the new applications and the last date is only one week away. I was completely unaware of the need because I was not notified earlier. The consultant told us that he had sent the papers to my Country 2 address, which I left almost 10 months ago. He did not reply to my question why he failed to send an email for confirmation of sending the papers to me. NEW SET OF PEOPLE FROM CONSULTANT ‘S OFFICES STARTED CONTACTING ME. The consultant has transferred my file from his Canadian office to Chandigrah branch.
March 2003: New application was filed. Meanwhile continued the French language education. ALSO PAID USD 1000 for filing a law suit in Canadian court against the rules that hiked the minimum required pionts from 70 to 75. Procured new PCCs from India, Country 1, where I worked prior to start the immigration process and Country 2. REMINDER OF 1000USD FOR LAW SUIT.
Sept 2003: Appeared for TEF exam .The new rules reduced the minimum points to 67. I asked the consultant about the new rules. No reply for a while. After my repeated emails, finally agreed that I have already got 67 without TEF. I sent my IELTS result to submit at CHC. NO REPLY ABOUT 100USD AND THE LAW SUIT.
Nov 2003: CHC wrote us that there would be an interview. Requested for another set of new PCCs
March 2004: left the job due to personal reasons and back to India
April 2004: letter from Consultant that was received in Feb 2003 from CHC to attend the interview in country 4.
May 2004: Interview attended in country 4 together with wife. Medical papers were given there and then.
June 2004: Medicals submitted, Landing fee paid. Passports submitted.
OCT 2004: CHC is reminded and to expedite because one of my son needs passport for the TOEFL. CHC returned the son’s passport and wanted another set of PCCs with in 45 days from country 2 and country 3. We requested the consultant to seek extra time. Consultant requested CHC up to Dec31st.
Nov 2004: New set of PCCs were arranged by first week of Nov 2004 but delayed by the consultant by TEN DAYS. Son’s passport is returned to CHC
Me, DEC 2004: Every thing is done. No light at the end of tunnel. Son completed Higher Secondary and Joined Engineering First year. Passports are with the CHC for the last 7 months. New Job offer in Hand to join in March 2005in Country 5. Listening the standard answer ANY TIME FROM NOW. Constant fear of request from CHC for FEW MORE PAPERS. Whole members of my family are CONFUSED. Every minor work is being effected by this confusion. ENTIRE FAMILY IS GROUNDED. What shall I do? Whether to take up the new job or not. I need passport back for the new job. What shall I choose the NEW JOB or THE UNENDING CANADIAN SAGA? If I ask the passport it may delay the process further.
MY CONSULTANT : I WOULD BE HAPPY TO LISTEN THAT “ MEN MAY COME AND MEN MAY GO BUT I AM HERE FOREVER. I AM THE POSTMAN OF CANADIAN IMMIGRATION SERVICE. I KEEP THE TWO WAY FLOW OF PAPERS BETWEEN THE CLAINT AND CHC LIVE.”

really so sad , why they make tis process so complicated , people becoming older when they receive visa & they lost all charm to migrate . why they immigration authority thke more fees & handle the case face to face , i mean you have to submit file at particulare consulate & their representive will look your case & check all documents in your presence . I am really depressed , i applied in september 2004 , after application with in a week my address changed , i informed to chc london about this but till date no meaasge / acknowledgement / file no from chc london . only action they did is to encash my draft ? hey all cds & massoodji can you tell me , if they encash my dd mean they gave no to my file , i am confused & depressed

I would say always keep one address which could be counted as your reliable address(parents, brother etc) one which isnt bound to change for all communications, Once any documentation is received it can be forwarded to you by your relative or so..That way it can prevent you of any mishaps as a result of delayed delivery.
I have applied from US and i am still receiving correspondance at the old address despite my fax and change of address application sent to US buffalo centre.

The thing I cannot understand is why the secrecy about the other countries?
Is Canada better than country 2, country 3 and country 4?

If so, then I am indeed sorry for the big mess.
This is a very plausible scanario and has happened to several people who got caught in the limboland during the transition from the old laws (pre-June 2002) and the new laws.
However, if this is a true story, I will say that the consultant in question screwed-up more than once.
First of all, if the applicant is Indian, the case should have been filed with CHC, New Delhi.
Or, at the most, with the CHC in country2.
Filing the application in country 4 was a very irresponsible decision on the part of the consultant because it will *always* cause delays.
It is best to file in the country of citizenship or the country where to applicant is currently residing.
The other unprofessional conduct was to give you the information that you will not be affected by the new upcoming laws when in fact you were.
Also, I think the applicant made the situation worse for himself by jumping around from one country to another.
I agree that he was seeking a good job, but that did not help with Canadian immigration.
In either case, it is a pretty sad story and has happened to lot of people.
