It is interesting that I couldn't get an answer for this question though I have posted it in many forums.

My wife and I are PR card holders and residing in US on H1B visa. We are planning to move to Canada this year end and we have a 4 month old baby who is a US citizen.

Clearly the PR for the new born has to be applied after we land in Canada and we don't need a VISA for the new born to enter canada with us because it is a US citizen and I guess the baby can stay with us for 6 months. After that what happens ??? Do I need to apply for a visa or extension ? Where should I apply for PR for the new born ? In canada or US ? I have no ties with US as I am only on a work permit here and once I move to canada the only tie would be my baby is a US citizen. Somewhere I read that I have to apply in the ASYLUM category !!!

Any help would be appretiated.

Based on you saying you hold PR card, I am assuming you have already landed and the baby was born after your landing.

All you have to do is enter Canada with the baby's birth certificate and passport (if available). Apply to sponsor as a dependent. Application needs to be filed with Mississauga visa office. All instructions are clearly spelt out on cic's website http://www.cic.gc.ca." rel="nofollow">LINK

Usually, it takes very short time to obtain PR for your child. However, if it exceeds 6 months, you still don't have to bother extending anything for your child. If you are crossing the border by land, simply show proof of PR application and say it is pending and you will be ok.

Remember, the timeline for application will be affected by the time it takes for you to obtain child's passport (if you don't have one) and complete the medical exam. Since the child is a US citizen, the medical exam has to be completed in the US by a US doctor and the application you file in Mississauga will eventually go to Buffalo.

Hi

I am not sure exactly but giving you some idea.
I went through this process almost similar only difference was
We were having PR and baby born in India.
We took Visit visa for her, again extended as not completed in 6 mths
Finally all process took more than 12-18 mths
So check if possible apply from US, may be u will get landing papers there.
But time required we can't say.
Most important or funny thing is after getting landing papers and other things
if baby is in Canada, you have to exit along with baby to re-enter Canada.
And landing papers will be issued only in birth country & not in Canada.
So again issue of sending her passport to US will come.
So think before doing anything
Best is complete everything in US & then enter Canada with landing papers

Yes. I have already landed in Toronto in 2005 August and my wife and I have the PR card with us.

The child is a US citizen and I have the birth certificate and the US passport with me now. I am planning to move to Toronto by end of October.

Do I need to do the medical exams for the baby now(i don't think so) or after I move to Toronto and apply for my child's PR they will send necessary papers to do the medical exams.

Also it is mentioned that I have to apply in Mississauga and then the PR application will be transferred to Buffalo. If transferred to Buffalo do I need to give a US address ??? Since we will all be moving to Canada, I won't have any address or ties with USA.

Since I will be in Toronto, driving to Buffalo would not be a big issue, may be I need to get a Visitor visa to enter USA ???

After you move to Canada, (which is the ONLY way to sponsor a dependant while on PR status) the only way is to file the application via Mississauga. You don't have a choice to send it anywhere you like as some other poster noted.

Once the application is filed, the application will be transferred to the CIC office abroad depending on the sponsored's nationality and/or habitual residence. In this case, the child is a US citizen and hence will be transferred to Buffalo. You need to have a Canadian address for communications from Buffalo and anywhere else.

Do not worry about having ties to US as you do not have to have ties. Hence no requirement to have a US address. You do not have to drive to Buffalo. When the time comes to "land" your child, you have to "enter" Canada which means you may need a visa to enter US, and yes, at that time Buffalo. Other alternative is to fly to, say India (if there is an opportunity) and re-enter Canada and complete the landing for your child at that time.

Filing a complete application saves a lot of time. That includes sending all the applicable fee and medical exam. Dependent child applications via Buffalo take less than 5 months to process and hence you do not have to fear about expiration of the medicals. All required paperwork for medicals is available on the CIC website and any additional paperwork is provided by the CIC doctor at the time of the exam.

Also, my best understanding of medicals is that the child has to use a medical practitioner from the country he/she is a citizen. In this case, it means using the CIC doctor from US (although CIC doctors are present all over the world, as it should be).

Please verify the above statement of mine and other posters carefully, else you will end up doing medicals again.

Finally, you will have to mail the child's passport to Buffalo to obtain the Immigrant visa. Use a courier service such as UPS, fedex, etc and have it returned via postage paid courier service. This is perfectly safe and legal between US and Canada.

Just an extra note. Your child may receive a stamp of "visitor's record" on the passport when you enter Canada for the first time with the child. Again, this is extremely at the discretion of the border officer. Most times, as a US citizen, the child will be let through with no stamps or records.
