I just checked my abstract and it did not show up. When I was at the court the judge told me that there is no demerit points.

And he was right. No points taken off. So I do not understand why is is bad. My fine got reduced. No points what more do you want?

You might not have any demerit points 'taken off' (sic); however, your insurance premium is influenced not directly by the number of demerit points, but by the number of infractions / tickets that show up on your abstract. If it hasn't already shown up, it probably will soon.

The ticket from the red light camera will likely be counted as a 'minor infraction'; with some insurance companies, this does not necessarily result in an increase in your insurance premium; however, get a second ticket (or if you have a previous ticket), and you could get scr*wed on the insurance.....now that could hurt!

There used to be a technicality that allowed these charges to be dismissed (which allows you to keep a clean driving record). This related to the location of the camera not showing up on the picture on your ticket. A defendant used it, a Justice of the Peace agreed with him, and the Ontario Court of Appeal upheld the JoP's decision. I haven't seen anything in the news that indicates that this position has changed.

If the defence had failed, you would have probably paid the full fine, which is $190. I don't know how much of a discount you got, but the 'defence' was probably a 'risk' worth taking.

BTW, the 'judge' didn't do you any favours by not 'taking off' (sic) any demerit points. There are no demerit points for an infraction involving photo radar.

I checked through my Insurance Company. You should also be able to walk in the MTO office and request on though I have not done that.

In short, these does not take the points off for sure.

My friend got this red-light ticket. He went and pleaded guilty, BUT also explained why and how the incident happened. His fine was reduced by $100 to his surprise. And no demerit points etc.
