Lawsuit? Without any contract? Big joke in Canada.
You made a mistake of giving him money without any written documentation and only other senior desi's could comment if there are any ways of suing him. To me there is none. What is he says that whatever you are saying is false?
He is a Lawyer and he also knows the rules / ways things work.
There was a statement in this board a couple of weeks back which said "Bouncing of cheques is a crime in India but not in Canada"
Even if your experience is true, I still doubt if you can extract a single penny from the Lawyer unless he changes his mind and pays you.

If you don't have anything in writing and you can not prove it, he may sue you for defamation. Do you understand it?

For us also keep such information posted can also create problem. In the past we had issues with it.

The best thing for you is to go to small claim courts. There are also some public lawyers. You may want to take some advise.


I also understand and appreciate your willingness to help the society by letting them know about such people, however as a public board we can not afford to have each and every claim verified.

I hope you understand.

Actually bounced check is plenty proof.. it shows both intent and action.
Problem is.. this firm being a legal firm is probably swarming with lawyers and you would have to go out and "hire" a lawyer..
You can definitely make his life miserable if you wished and got his name in papers.. In any case he's probably got more to loose in case of defamation suit.. if it comes out that this firm is promising folks visa guarantees in lieu of money ultimately it comes as his word against yours and trust me he's more worried abt it than you ..
Please note your hometown papers like Gujrathi newspapers and others will probably be more sympathetic to the story and that's where their major revenue steam is coming from.. hell for couple of thousand dollars you can get local goons to trash his Baroda office.. So you are not helpless but frankly.. "What the heck were you thinking??"
Is your brother a legitimate student? if he isn't and your whole case was based on taking advantage of canadian laws and you found a lawyer who was willing to do that and now you act surprised that he wasn't exactly honest in your dishonest agreement?? what is it? Godfather or Satya.. ?? Crooks are honest in their dealings with other crooks.. with common folks they always act as crooks!!
If you want to..
Go for the whole hog.. start by suing the bastard in civil court.. Get your local influence to do dharna/satyagraha in front of his India office, and get local police there to put someone close to him in jail for couple of nights.. trust me.. he'll wanna talk to you..

Otherwise..
Put it under "Akkal Khata" and let it go .. :-)

Actually local newspaper here are all cowards. They don't want to get into any of these mess. However, I am going to print some flyers and distribute to local temples. Also I might be able to do some in India with their Baroda office.

I am not going to let him go that easily with my money. Civil court option is not good one, as that will take years to recovery any money out of him. Courts in Canada are not any better then India.

Take him to Small Claims Court where No Lawyers can intervene and the Judge will probabely award you interest accrued if you ask for it.

I heard even when small claim court orders people to pay, they never receive their money. Is this true?
