US Visitor visa denied

My wife is a landed immigrant came to Canada in June 2009. We applied for her US visitor visa last week and it was denied under section 214(b) of immigration act. Visa counselor didn't even look at a single supporting document that she carried along with her. He just said that you have not lived in Canada for a specific time period and hence I can't provide you the Visa. No where on their website they have mentioned that one has to live in Canada for certain period of time before applying for US visa. Did someone else had similar experience? What can be done? When can we apply again for the Visa? I am a Candian citizen and wife is still PR so she need the visa to visit US. I provided her all the necessary supporting document but like I said visa officer didn't even bother to look at those.

What would you expect from them after landing only in Jun 2009?

So how long one should wait before applying for the Visa? I know someone whose wife applied after 2 months of landing and got it.

Well you may get US visa very next day after landing in Canada, but chances are slim. Chances vary from person to person and circumstances to circumstances. I would say ( I may be wrong) to be on the safer side wait at least one year before you apply first time, now you have rejection on your passport so I can’t say what would be the safer time limit to re-apply.

My wife applied after 2 months of landing but she had a job and she carried the my employment history and my US visa copy..

As soon as they found out i had canadian pr and have usa vistors visa and my sister is citzen of USA , they gave her the visa..I had lived in the usa and moved to canada.. so it must have been counted as positve.

I think ur luck was just bad..

Getting a visitor visa is no different w.r.t. the process if it is in India or Canada.

i.e. Demonstrate that you have strong ties back home . A job is the best tie....a HOME + JOB is even better.


In your case, you can re apply once your wife can demonstrate that she will come back to canada.

I would say wait atleast 6 months & have some concrete evidence re. ties to Canada
