Hi
I am an international student and will finish my 2 year program in August 2017. I am getting married to another international student and she will finish her 1 year program on August 2017. I have few Question if somebody can answer me please.

1. Is it possible to apply work permit together and get 3 year open work permit for both of us ?(BY SOMETHING LIKE SPOUSE/DEPENDENT VISA)
2. Do both of us need to inform CIC right away as we get married ?
3. Do I have to show funds in my account if I proceed as I mentioned above.

BOTTOM LINE IS WE BOTH ARE INTERNATIONAL STUDENT IN CANADA I WILL BE 2 YEAR GRADUATED AND SHE WILL BE 1 YEAR GRADUATED. CAN I GET 3 YEAR WORK PERMIT FOR BOTH OF US ???? IS THERE ANY WAY TO DO SO ????

I am sure by now you know that there is no such classification in the Canadian Immigration system such as Girl Friend and Fiancee. So, it has to be either Spouse or a Common Law Relationship with your Partner. So, please read through the next two paragraphs and see what it is that you want to do.

You may apply to sponsor a common-law partner to Canada, of the opposite sex or the same sex. You simply have to prove you have been living with your Common-Law Partner for at least 12 consecutive months in a relationship like a marriage.

The documentation you submit for a common law sponsorship is more intensive then a spousal sponsorship in the sense that, in addition to the other requirements, you will need to demonstrate the additional factor of cohabitation. Many people struggle with documentation in this respect as how do you show progression of time with documents? This can be remedied by submitting joint bills, for example, over the span of time. Provided they have both names on it and have the same address, submitting a years' worth of such bills is a good way to begin demonstrating cohabitation to an officer making a decision. Aside from this, your documentation should also reflect the genuineness of your relationship.

Based upon this you will have to prepare well to document that you both are determined to stay together and prove it to the satisfaction of the Immigration People. More on it if you wish to take it to the next level. (I want to keep this as short as possible.)

You know you will get your Open Work Permit for the duration that you are seeking. So also she should get it for a length of period of her study. SO, you both have a lot of time to do what it is that you want. But do get the Open Work Permits.

If she is married to you then it is possible to obtain for a similar period. Can you prove either one of the above conditions and meet their requirements and qualify.

It is always good to tell them that you both are married to each other. That way they will issue to both of you the OWP for the same duration.

It normally does not call for funds at this stage. Please see the application for renewal of the Temporary Visa. You both will have to work and obtain your Visa (TRV) and the OWP and pay for it.

Please make sure you BOTH work at a level in an NOC category that will let you in on the EXPRESS Entry. Do not take jobs that are NOT Recognized by CIC. (IRCC) Then save a few bucks and show the same if they ask when you apply for your PR cards.

Thank you very much for the response and sorry for creating new threadI am not used to this site but will be good shortly.
Now We are getting married just in couple of days. From your reply I figured out that if we are married officially than it is possible to get OWP for both of us.
QUE-
*Can you tell me procedure to make it possible even if she will complete only 1 year diploma course.
*Should I go for a lawyer or I can do it myself ?
*Is there any chances of refusal of work permit to both of us if I apply for 3 year OWP for both when she is only 1 year diploma ?

You still have a little time on your hands. So, plan your wedding well and do it the proper way and also in the City Hall and get a Marriage License and it could be done in 30 days. (Unless you both have already tied the knot.)

You must by now know most of what it is that you should do to prove and consolidate the Married status. Change of name and joint account. New Id Cards with Married name etc., are good to have. Pictures of the wedding, a Video also will go a long way and having the same address are important.

When you both are MARRIED, the status automatically changes to a spousal Sponsorship. Being the spouse, gets the privilege of staying with you for the THREE YEARS here within Canada and also work here and can apply and get the same THREE YEAR OPEN WORK PERMIT just like what you do to get one. There is NO special requirement other than being together, which is the most Important part of it. (First part is she is here with in Canada Legally, the Second Part is Married to a well qualified Immigrant holding an Open Work permit for THREE Years, earning a high Five figure salary. You document all these items, all by your self, can you?) Have all these documents Notarized also. That will clinch it. If you need proper guidance drop us another note here under this. You are on the right track. Now you got most of the answers, plus an ounce of courage.

EDUCATIONALLY, now she is a well qualified person. (Not knowing in what field, I left the question to you to get things moving.) If she is a Certificated Individual and can join a UNION and seek a suitable post, then she gets a better footing. Also you must seek a job that is in demand in the NOC category to settle with in Canada. Can you check for your own NOC Classification and work from bottom up? Then you are all set.

You both will be Married Very Soon. You will also be on a Three year OWP. Your wife just RIDES on your coat tail. She is allowed into Canada and do as she pleases, but to work in Canada, She by herself is eligible for one with an years validity, if you ask, they will issue to her the same THREE Year OWP, just for the asking. How is that for help. At the same time if she is CERTIFIED, and holds a Union Card, then it seals the deal.

They are GOOD that way and are very obliging. You can stop worrying about it.

Going to lawyer is a choice. Since filling the forms are done by yourself sitting in front of a desk, I will leave it off for the time being. They have done the same many times, so have I. I am sure you can do the same yourself. If in doubt quote the document # and the question you are doubtful about and you will get the generic (correct) response to it. fh

I got the marriage license and will get marriage certificate by mid of August 2017. I got photographs of marriage, joint bank account to prove that we are together as well as cohesive to each other. I will be applying for PGWP in September.
QUESTION
1. Should we inform CIC that we both got married. IF yes How can I inform them about our marriage ??
2. While applying for PGWP for 3 year for both of us should I go for online or offline application.
3. In case they deny 3 year open permit for my wife, will she get 1 year permit as she completed 1 year course or her 2 year study visa will be considered ?

Congratulations once again. How did it all GO. Must be a great feeling. Enjoy the Bliss.

If the course she completed permits her to work during the SUMMER of that year, then she can work till the start of the next Semester or the year. ONLY if she completes the course that she enrolled to complete, which could be TWO years in her case, will they issue to her a Work Permit with a letter stating that she has successfully completed her Two Year Course and it will also state that she is hereby permitted to obtain such a Work Permit. Please consult the location where she is enrolled for her courses. Also find out from them if she can drop out for a semester or two and continue when she is ready to resume. These are formalities and you should get the answers from the Study Center where she is enrolled. But get everything in writing from them.

One thing that you should remember, the minute you say that you both are married and are staying together here in Canada, (BOTH) being a LEGAL Immigrant (TRV) will get her into a status called SPOUSAL Status and it automatically will enable her to get the same privileges that either of the spouse does enjoy here with in Canada. Which in your case is entitling you to a THREE YEAR WORK PERMIT. She also will get into that category and when you apply for your WP, please include her too and pay the fees for the same. I will provide under this some materials to read. She has two year study visa. She can extend the same about three months before it expires. So the WP that you or she can apply will be only for the two year expiry. But if she applies and extends it to the same period as you, then, when you apply for your 3 yr work permit, she can get it for the same period. These are the catches, which you should get to know and over come them smartly. After you extend her VISA, you apply for the 3Yr W.P.

BOTH of you MUST inform CIC the change in your status. Please read and fill out the forms. Also call the CIC and ask for the right forms with information package. (You can down load and print the same. for your reading)

YES, when you file an application on the web, it gets processed in 50 days, where as the Paper Route takes about 115 days. So do the web filling. Please double check for spelling and mistakes and also keep the CHECK LIST handy and verify that everything is hunky dory. Then Click to send and file. Please Print and Keep a Copy for your files.

Attach all of the Documents. (Preferably Notarized) Name Change, Passport, DL., Banks, Rentals, Lease so on so forth...
