Hi! Guys

What's the minimum stay required to maintain PR status under new rules.
Is it 2 years or 3 years in a block of 5 years.

Is it necessary that this stay should be in single spell or the total number of days stayed in canada during a five year period is counted.

It's 2 out of 5 yrs. The 2 yrs can be aggregate NOT single spell.

Can Mr Massod, or anyone else explain the meaning of "block of five yers"? I landed in Canada in 2000 - does that mean that from 2000 to 2005 I have to stay in Canada for 2 years and then again a total of 2 years in the block of 2006 to 2010? If that is so, does it mean I can go out of Canada in 2003 (after having lived the full years of 2001 and 2002) and then still maintain my PR status till 2008 and then come back for 2 years?

Or is it that in any block of 5 years I have to be in Canada for 2 years. If that is so, it would mean I can go out in 2003 but have to come back latest by end of 2005 or early 2006 so that I can complete 2 more years before end 2008?

Kindly clarify.

I have still not been able to get a good answer to my above question in last 5 years - does anyone have a clearer picture now?

At the time I raised the question, I was a PR but now I am a citizen. So this question now only serves an acdemic purpose for me but can be useful for others

It is a sliding window of 5 years.
So at any given point in time after you complete the first block of 5 years, the requirement is to be present for 2 years out of 5 previous years starting yesterday.

So in your example, between 2000 and 2005, you need to accumulate a total of 730 days (2 years).
After 2005, at every given point in time, you need to maintain 730 days presence during the previous 5 years.
It's easier if you think in terms of days vs years.
I think the "years" terminology is confusing for everyone.

Dear CD,

I migrated to Canada (Toronto) in August 1, 2007 and came back to my India on August 1, 2008 exactly one year stay in canada(due to some unavoidable family circumstances). My PR status is valid till August 2012.

My question is Can i come back to canada by October 2010 or March 2011 and still maintain my PR status? If yes then do i need to inform the embassy for my arrival to canada? or else i just need to board the plane with my luggage, passport & PR card. I have been to different posts but unable to understand the timelines. I will be really grateful to all CD's for help me in this regard.
