Maintaining Canadian Status

Before I even start , please read this link that we discussed long time back.

So, now the situation is that I have already completed 2 years and we got married on 4th May 2004 in Canada, and since then I have been living with him in USA , he is now a US citizen.
I did visited Calgary for few days , and then came back to USA again.

We got legally married in USA too and he is now filing for my paperwork, for my greencard.

The question is :-

Although I did spent sometime in USA with him, I dont like USA very much . Its not where we want out kids to grown up. We wanna move back to Canada.
That means I wanna keep my "Canadian Status", even if I get a US Greencard.

How can I do that ?

Hi there,

I've edited the title of your post to a more meaningful one.

To answer your question, the only way you can legally maintain your Canadian PR status is by fulfilling the obligations mandated by it, I think currently its 2 out of 5 years stay in Canada.

OR

You can fulfil the time necessary for your citizenship and then both of you can live in either country without worries.

I have already completed 2 years out of 5 years in Canada. And thats why after that we got married and I have been living with him in USA from past one yaer.

what happens from here ? Thats what I need to know.

U can stay for 2 more years in the US w/o affecting ur PR status @ Canada. The rule states in order to maintain PR status u must be in Canada physically every 2/5 years.

what about the the tax filing. don't they ahve to even file for taxes and maintain their status

I have been staying in USA from almost one year with my husbnad and I still had to file my taxes for last year till May ...when I stayed in Canada.

No..you have to keep filing till you tell Tax dept that you have broken all ties with Canada, including but not limited to bank accounts and OHIP and Driving licence etc.
