My parents got visitors visa on sep. 7 for six months and arrived in Canada on Oct 17. The date of entry is stamped on the passport but there is no date for exit.

1) How long can they stay in Canada legally? Do they have to leave before the expiry of the date as stated on the visa or six months start from the day they arrived in Canada?
2) We would also like to extend their visa and get multiple entry visa while extending it. Can we do that?
3) Will there be any complications if we intend to apply PR for them?

Thanks

Hey dhar ram

1)afaik they would have to leave canada before the expiry of the visa in this situation as the io has not put in any exit date.(pls correct me if i am wrong)

2)you can definetly extend the visa however it totally depends upon the descretion of the io to extend the visa or to reject ur req

3)Many ppl come to canada on visit visa and apply for pr(thats what i have come across)

cheers
prince

The above links might help. In summary, visitors are allowed to stay upto a max of 6 months. Visitors can extend their stay by applying 30 days before the visa expires. Note that the extension of stay does not mean the visitor has recieved a new visa, it only means that their stay for additional time has been authorized. To actually get a visa, they must leave the country and apply at a consulate abroad.

It is not clear whether visitors can stay beyond the visa expiry date (upto 6 months), i.e, 6 months from the time they entered.

They can apply for PR while they are here. However, their application will be processed at their home country. Entering in the future as a visitor while the PR application is pending might be difficult and may raise more questions.

Thanks Prince and Dimple.

This same information I have read on cic website which states that visitor can stay upto 6 months. But yes, it is not clear whether the six months start from the date they entered. Lets take the case of 2 years multiple entry visa. In this case person has visa which is valid for 2 years though they are allowed to stay upto 6 months from the date of entry. So even if they enter Canada in their last month of expiry as it shows on visa, they will still be allowed to stay maximum 6 months, exception to the immigration officer not stamping the exit date.

1) So does this mean that visa period states the period within which visitor can enter Canada and then IO decides how long they can stay?
2) Is there any contact office in Toronto which can provide further details on this?
3) Can I send a request to extend visa when there are still 2 months remaining in expiry?

Dharm,

it's 6 months from the date they enter Canada if there's no date stamped on teh ppt which seems to be the case here.

What I'd recommend doing is calling the Canadian border officials at one of the bridges (rainbow bridge, peace bridge etc) and asking them.

Also, it's not recommended that you apply for an extension prior to 30 days before expiry as it can be a reason for denial.

Hope this helps...

Hi Dharam.

You can call one the CIC office and you can asked them for when Visitor visa is going to be expired for your parents?

What we did last year my Father and Mother in law came here. The same situation happened there was no expire date on passport. we call the office and provide information on very next day and they told us your visa is for six months only.

Try to call the CIC office i forgot the no.

Cheers.........
