Can you explain what you mean by "Illegal Basement".
As per Ontario Building Code (OBC) , All basements are legal.
Do you mean that some unauthorised activity is taking place in any basements?

Why you need to do that? Has any illegal basement caused any damage to you?

I am busy at this moment to access the by-laws (if any) restricting the finishing of basement for 2 years after construction but i can tell you this :
From my personal experience, i have seen basements being finished even when the house is being constructed ( without even architectural drawings) and so i donot think that there can be any such restriction.
Just a common sense thinking : Do you think that a country which allows toilets / Habitable rooms like bedrooms to be built without windows would not allow people to live in basements? I think not.
India has a specific rules which requires min. area of openings for toilets and habitable rooms.

On a side note : This case looks like the tenant living in the basement of the Landlords house and paying his rent by cash to the Landlord. The tenant may have asked for the rent receipt to claim ontario rental tax credits and maybe the landlord says that he canot do this b'cos he is not disclosing this in his tax return as a rental income. So the tenant wants to know if he can report this. This is what i infer. if it is not , please excuse. I am not writing this to offend anyone. I will edit my post if it offends someone. Thanks in advance
