Give the poor guy a break. Do you kick someone when he's down? He was asking for some advice. Yes, he may have made a mistake, but you could be more sympathetic in pointing that out.

TK - I have dealt with HR on matters like this in the past. Have you received written notice earlier that you were not performing your duties? That you spent too much time on the internet? You cannot be fired for non-performance with prior notification (not verbal). If your employer cannot prove this, you may have a case.

However, do you want to fight this? If so, you should work out how much it will cost you financially. Hope this helps...

Guys !
Thanks for all the feedback. Now I am very confident that I shall get EI.
I am not looking to actually file a case with a lawyer / Human right court b'cos he was my previous employer and that he actually makes it possible for 7 visible minorities to put food on their table. The reason was that since I worked 6 1/2 years in that firm, he took advantage of me while people who just joined go scott free for doing nothing.
To answer some of the queries asked :
1. I donot think that I will ever apologize even if he puts fired in my EI. I am trying to get in touch with some of my collegues.
2. I think what MR said was totally out of the line and not at all in touch with reality.
3. The market is very very bad esp. in construction. It is just impossible for me to get another architectural job (even in India and the gulf) and hence I am planning to study SAP (whether I get EI or not). I will be starting a seperate conversation on that. I know atleast 5 people who were let go from another office (our competetor) who have worked there for 8-20 years. I am recommending one of that person for a job in our office (indirectly by giving them details of whom to contact). With me out, the office needs atleast 3 more people.
4. The EI regulations regarding termination are very subjective. For example, it expects the Employer to document the activities happeneing from when the issue was discovered right till when I am fired. I donot think he did that. The only time that I will be in soup is if he can produce documentation as to what sites I visited and the duration when I was in office which is a lot of time.

TK, based on how you have described the scenario, my feeling is that this has been brewing for a while.
You were asked to complete a piece of work that took 2 days and 2 hrs. i.e. 18 hrs. (assuming you worked 8 hrs. a day).
You were initially asked to finish that work on the same day.
Now as someone mentioned earlier, if 18 hrs. is normal and customary for the work you were given (i.e. you weren't slacking), then asking you to finish it the same evening is unreasonable and cannot be used as the reason.

Therefore, I think this situation has been brewing for a while and this incident was the last straw.

Please reflect back and try and figure out what the root causes and reasons were for this.

Also, the Internet use works against you so don't push it.

Sorry to hear about your sacking, Tamilkuravan. I have an extremely short fuse. I usually give it back to the a$$holes with compound interest and without caring for the consequences. So I can relate to you.

When I joined a desi consulting company in US(during dotcom era), bubba would change my resume without consulting me. I had to deal with extremely embarassing situations with at least three clients. The third time around I blew my top.

I slammed the laptop on his table and just stormed out the office. Now I regret to find out (many years later), at least half a dozen employees sued those buffoons and were as a result well compensated by court order. I would have been too if I continued for one more year with those jokers.

So josh is good only if tempered with hosh.

TK, sorry to hear about it.
Keep a positive outlook and i guess learning SAP might be good idea.

I know you have many friends/contacts in ERP but for SAP you can also count on me.
Incase you need any advice regarding which Module or technology to pick in SAP, just let me know and i will guide you.

Sorry for the job loss.
What the hell is wrong with us Indian people?

TK, sure he was paying you money but you were working for him and giving him your time. It was tit for tat..this was NO charity.

Think positively, something better may come out of this. The economy is slow now, you can do some courses, you have a lot of experience, you can even start your own company in a year or two.
Economy will pick up...it is always not going to stutter, IT WILL PICK UP.
See this as another challenge.
Look up to Obama, he is facing the biggest challenge any American president has faced. He is confident, calm and always, always positive.
BE POSITIVE....By showing your feelings to your boss, you did the right thing.
