Sponsoring Spouse - Do it in Canada or in India

My husband is a Canadian citizen, and we finally (after 6 yrs) decided to file for my PR. We are in Calgary. I am in Canada right now on Visitor visa. Wondering if we should apply for it for within Canada or from India? We were living in USA for the past 6 yrs, and just returned back to Canada to settle. Shall we do a lawyer as we do not have a proof of income in Canada. He has been working here but it's his own business so he never took out salary for himself before.

Any help will be greatly appreciated.

Using a Lawyer or a consultant is simply this: He will keep the sheet of paper in front of him and he will ask: What is your name, where do you live and so on so forth. You answer these questions faithfully and the form gets filled, but he fills it. Then you pay him the money and get out. Now you have a lawyer who represents you and you are stuck with him regardless of the out come. What does he do for you after that??!! (Zil....)

These forms are simple and has no catches, Simple and straight forward. So no need to fear. If you have any doubts about any line in that form drop us a note here and we will help you. (So also, any Immigrant Help Centers there. But I don't have the list. But Catholic Family Services comes up to the top.)

You get the forms and fill them out and send them to Mississauga together with the fees etc., In about a month they will approve the papers and then forward them to India. You provide to them with an Indian Address in the application for them to get in touch with. I am sure you do have one, as the Passport is registered at that address.

You can extend the visitor's Visa as long as you can do so and then get back to India and wait for the completion of the process. It sure takes a long time and it runs into an year or longer. So, be prepared to take that separation period into account.

You still will have to cross the borders and return to get the entry Visa for the PR. Cross that bridge when you come to it.

so you suggest we do it from India vs doing it from within Canada (spouse in Canada vs spouse in India)?? I have the visitor visa until Aug 2010, I was wondering that as long as I applied for it from within the country(canada), I should be able to hopefully extend my visa and not go all the way to India. OR is this NOT recommended ??

You apply for her P.R. and provide them with all of the required fees etc., and submit the application. Since the children are here within Canada, the process is the same for them too. Please include them in the same application. That is the proper way. Hang in there as long as it will allow your wife to stay. If you have Multiple entry Visa, return back and ask for extension. If you get it, then there are no problems. Otherwise you know what to do. Some one who is handling your files could have a very soft corner and might let you be here. WHO KNOWS?!

There is another avenue with the Humanitarian and Compassionate grounds. So, see if they will play along with you. You will have to do the pushing, with request for the visa extension etc.,

Whatever they ask you to do, you do and comply. They hold.....

You can choose either option in broad terms the differences are:-
-Doing it in Canada it takes longer but you are with your partner/family [It took me almost 9.5 months] but can't work.
-Outside application is quicker

About your visitor visa I guess once you've applied as in Canada you can ask for extension if you have not received AIP or PR. But do a search in this forum you will get plenty or try this http://www.immigration.ca/discussion2/ .
If you read these two discussion forum I'm sure you won't need a lawyer.

Seems like in Los Angeles/Buffalo it takes around 2-4 months.

Also, I should mention that this is second marriage for both me and my husband, does that mean it will take forever (so might as well do it in Canada). I am thinking of applying for the work permit also at the same time as the PR application, this way I have the implied status. My concern is that during the wait period if I have to travel out of country, will I be stuck??

I have 2 little ones so it's not easy for me to take them all the way to India and live along with parents while I wait for the process. Hey, I wasted 6 yrs already, another yr won't be that bad; as long as we are together!!

Here is a link to the application forms. Provided there in the last post there.
It is for applicants FROM WITHIN CANADA. Please read the guide there in.

Things will resolve by themselves after your submission. Follow the process. Do keep us posted if you feel that we should know the procedures too.
