Hi,
One of my friend is a landed immigrent to canada. He entered canada around 2 years back, took PR card, completed the formalities, and went back to US on H1B visa. Now he wants to come back to canada. But during his stay in US, he got a baby. Now the baby is just one year old, but holding US passport. Does they need to apply for PR for the baby?
Does US citizen also apply for T1? Where does they apply? At the port of entry? Does the baby need any earlier paperwork?
Both her parents holds Indian passports and canada PR cards?
Kindly clarify.
You should check with a lawyer to be sure but I think I can give you an idea about some of the things you asked.
"Now he wants to come back to canada. But during his stay in US, he got a baby. Now the baby is just one year old, but holding US passport. Does they need to apply for PR for the baby? "
Answer = yes. They need to apply for PR for the baby. In fact he may have trouble coming back to Canada with the baby.
There is nothing such as a T1 for US citizen. US citizens can normally enter Canada without visas of course but only for temp stays.
Let me also add that the fact that they had a baby in the US could be an issue when entering Canada.
