HI ! My spouse he is Canadian by birth, he will be applying for Canada family sponsorship under CIC to sponsor me from India. He will be submitting documents from Canada itself for approval.
I am an Indian by birth. i 've all documents including my 10th certificate , except my Birth certificate as i was born at home.
I also have an sworn notarized affidavit in support of proof of birth from Indian court.
Please kindly advice me what to do in this situation as i have no documentary proof of birth certificate except the affidavit . Thanks.
MY birth was never registered 32 years back. Will CIC accept if i provide both the 10th certificate ( included my name, DOB and Father's name) and notarized affidavit from magistrate ?

Currently Government of India is issuing an identity card with your NAME, AGE, GENDER, ADDRESS, PARENT/SPOUSE'S NAME and should be valid for your identity. It is called AADHAR. You should have one such card.
If you can find a broker who can obtain a BIRTH CERTIFICATE, he will obtain you one from the local Tashilar's or Mamlatdar's Office for a very nice sum, as they have the know how to get one. Not knowing your location, you must do all of the spade work all by yourself at the Indian end.

@Full House - Thanks for your reply. I'm from Mumbai. I do have Aadhaar card, Voter Id, Pan Card, Ration Card all available Indian identities.
I also have Marriage certificate, spouse's name added in my Passport. For birth certificate i 've a sworn notarized affidavit stating my "place of birth" and Father's name, which was accepted during Police clearance for Passport processing. I showed my 10th and 12th Certificate and Marks Card ( included my name, DOB 'n Father's name) for proof of birth during passport.
My Father , Mother are both Indian by birth and i have all their Identities.
Me and my spouse ( is Canadian citizen by birth ) we both have common relatives.
i was born at home(Mumbai) and birth was not registered during that time. I will try to get
Non Availability of Birth Certificate (NABC) from municipality.
According to "Sponsorship of a spouse" living outside Canada ( for Indian's ) , these are the documents they require as given in CIC website :
IDENTITY AND CIVIL STATUS DOCUMENTS
Birth and/or baptism certificate
Note:If the birth is registered late, include the original baptism certificate and other original documents establishing identity such as:
•old school records (Fifth class, Middle standard and Matriculation certificate), and
•Voter’s ID card.
Court documents concerning custody of children, if applicable.
For any family member who is a Canadian citizen or permanent resident of Canada, send a photocopy of their:
•citizenship certificate,
•permanent resident card,
•Record of Landing (IMM 1000) or Confirmation of Permanent Residence (IMM 5292 or
IMM 5688),
•immigrant visa.
Hope it wouldn't be a big hassle as i do have :

I would try my best to get • baptism certificate / Non Availability of Birth Certificate (NABC) from municipality.

The date of birth as noted in your School Leving Certificates will do.
You also have a sworn affidavit that is acceptable.
Just out of curiosity, is the midwife who was present at the time of delivery still around some place where you can access the records s/he maintained by him/her, if so please get a copy or from those records, the events as occured on that day. During those years they were meticulous with their record keeping and the nearest family might be in a position to access them and give you a copy. Also they might have maintained a register too. Just my thoughts.
You are O.K. with your documents. Please make a photocopy and retain them and in a different location.
Please prepare thoroughly for an interview with the Immigration officer, just in case they want to hold one.

Unfortunately, they do not accept all those certificates / cards etc., you are talking about. They ONLY accept any of the following two.
1. Birth certificate issued by the local authority
OR
2. An Affidavit (original) made by you stating that you are born so and so date to the so and so people. (you need to include your both parents names).
You will say that you are making this affidavit as you do not have a birth certificate. ( You do not need to tell why you do not have a certificate).
So ... make an affidavit, have it notarized and send the original. That will work.
