Renewing Indian passport of a minor whose father is a refugee claimant

Hi ,
I am living in Canada since 2008 and I have applied for refugee status (my application is still under consideration). I was holding a Indian passport which expired few years ago.
Now my daughter who is 11 years old , need to renew her passport. But I do not have a valid Indian passport. I checked the passport website and it seems that I need to get Annexure H attested by the Indian Consular .
Could anyone suggest if Indian consular will attest that without any concern.

Why have you claimed refugee status ?
If you say you were being discriminated by India in India , hence you fled India for political reaons ( political prisoner ) ..then India will say , why do you need an Indian PP now ??..if you fear for your life in India
..your daughter will be at threat too Just a clarification , I do not need Indian passport , but my daughter does. Because she is a minor , both parents should give their consent for that.

I will explain to you the situation that you are in and see if you do understand and work with it. (Also some of the details are required to help you were not posted in your mail)
You entered into Canada somehow and wanted to stay here. (I do not know how many of you came into Canada?)
You stayed here and also stayed beyond the permitted stay period, and claimed a Refugee Status. So you do not have landing papers and hence have any legal status here in Canada.
If it is the same, then your wife and children are also in the same category.
Hence when your Passport's validity expired, you found that you cannot renew it any more, because you are in a territory illegally, till you either normalize it and get PR status or you and your family will get deported out of here, if and when you come to know about the outcome of your claim to a refugee status.
If their status being the same as yours, your wife and children will fall under the same status as yourself and hence will not be able to renew their Passports too.
To renew your Daughter's Passport, you will need a Valid Passport for BOTH yourself and your wife also., which you both do not have. So, you are not able to fill out the Annex 'H' application.
So, I will request you to get in touch with a lawyer there (whom you already have) and also get in touch with an individual in VERY HIGH standing in the community and through a legal document appoint him as a LEGAL GUARDIAN for your Daughter and after you do that, ask the same lawyer to help you getting your Daughter's Passport renewed for a period till she reaches the age of 18 years.
This could be some how or other accomplished, if your lawyer can help you. But there might be other implications that he will have to explore and one such topic is losing the custody of your daughter for the renewal purposes and also till the* age at which she attains the age of majority.
That is the avenue that opens up in my mind and if you are able to accomplish this do so, also please let me know if my suggestion holds good and also worked for you.
