Can somebody apply for the certificate before obtaining the Canadian passport?

If you read the instructions on the CGI website, among the documents required, it mentions "Copy of Canadian passport, if held.", however the actual SC form lists copy of Canadian passport as one of the enclosures.

Bad news.... I had to pay $240 penalty because my passport expired in 2005.

When I called help line they say I do not have to pay the penalty... I do not know who is right and who is not.

I feel sorry about your loss, but it is already mentioned on the website about this.


The Consulates would levy penalty if the Indian passport has not been cancelled for more than 3 years, or if it had been utilized to visit India or any other consular service was obtained after acquiring foreign nationality. The penalty would be in addition to the Renunciation Fee. Contact the Consulate to find out the exact amount of penalty.

Broadly speaking, following are the provisions relating to penalty:



Penalty for Retention of Indian Passport after acquiring Canadian citizenship for a period in excess of three years from the date of acquiring Canadian citizenship
(a) if your Passport expired on or before 31 Dec, 2004 – no penalty
(b) if your Passport expired on or after 1 Jan, 2005 – C$ 240
Penalty for travelling on Indian Passport after acquiring Canadian citizenship is C$ 240 for each time, subject to a maximum of C$ 1,200


However, if you can write to the CGI in Ottawa/Toronto, protesting against this discrimination, there is a hope to have it refunded.

which helpline? CGI does not answer phone, so I guess you are referring to VFS. Regrettably VFS staff do not know much as they don't make the rules but then they should also not be giving wrong advice in these matters. You can send a complaint to VFS, see http://in.vfsglobal.ca/complaint.aspx

Today my wife submitted passports for Surrender Certificate.

We have acquired citizenship over 3 years and the penalty was waived after we showed oath documents. (Don't ask me how it is different from citizenship certificate card)


Therefore, carry oath document along as it may be useful.
